Hello!

I just have a question about the EAD. What is the difference of the catagories ©(9) and (a)(6)? Which are you suppose to file for? And do we file before his entry, with AOS or after AOS? I read the guides, but I am just not getting it, I guess. :unsure:

For K-1 you file for EAD with or after filing for AOS, Using (c )(9 ) (I-485 pending) it is FREE because the fee is part of the $1010 paid for AOS.

If the K-1 were to file for EAD before filing for AOS using (a )(6 ) the results is that you Pay $340 for an EAD card that expires the same time as their I-94 card. A EXPENSIVE USELESS EAD CARD. (a )(6 ) is the same EAD as the temp EAD stamp issued at some POE.

K-3 holders may consider (a )(9 ) EAD and just wait a while before filing AOS, K-3 would get an EAD card this way that is valid up to 2 years, and waiting to file AOS until just before their 2nd wedding anniversary can save them from having to later filing to lift conditions on a conditional green-card.

I made that mistake and was worried sick that my hubby would be denied. Thank God for VJ! I found the mistake in time and corrected it at an infopass appointment. It worked out!! But I think we were lucky.

My hubby even got a job today!! It was fast considering we were on vacation for 2 weeks.

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

05/24/07: I-485,I-130 and I-765 Mailed AOS/EAD to Chicago

05/26/07: The package arrives to P.O. Box

05/30/07: NOA1 Received date

06/04/07: NOA1 Notice Date (Day 1)

06/05/07: Checks are cashed.

06/08/07: NOA1 arrives.

06/08/07: Biometrics notice date (Day 5)

06/15/07: Biometrics letter arrived. (Day 12)

06/21/07: Touched-first time:)

06/30/07: Biometrics appointment (Day 27)

07/02/07: Touched- I485 & I765

07/16/07: Interview letter arrives (Day 43)

08/08/07: Touched-I485

08/11/07: EAD start date (since no update online, I assume this is the approval date)

08/13/07: Touched-I485

08/20/07: Got EAD in the mail. (No touches and no email notification) (Day 78)

08/21/07: E-mail notification for EAD

08/27/07: Interview (Day 85) approved, but had to resubmit the birthcertificate

09/26/07: birth certificate is submitted, passport stamped. Receive "card production ordered email"

10/04/07: "Welcome U.S.A." letter received.

10/10/07: Green Card received. (Day 129)

So in a nutshell, immediatly after we are married, file for EAD (c9), which is part of the AOS package, and just pay the $1010?

If you're going to file for an EAD under C9 then you need to file the EAD at the same time as your AOS (I-485). If you do this then yes, the EAD is included in the $1010 price tag for AOS.

glad i saw this thread, i was going to send in my AOS/EAD/AP later today and i put down the (a) (6) on my form. other than © (9), is there anything else i need to put in that section?

First contact: Oct 14/06

First meeting: Nov 6-13/06

Engaged: Dec 29/06

Moved to US: June 28/07

Married: July 14/07
