k3 and back for cr1

hey everyone!

I am going to go to the US next week with my K3 visa.

Our I-130 has been approved at CSC as well in the meantime and I want to return to Germany for the interview then as I know the consulate, their ways and the people there.

I just have a few questions:

1. Will the NVC send the first couple things to my address in Germany or to my hubbie/my new address in the US?

2. Should I inform the NVC of my residence in the US as a K3er prior to them generating anything?

3. Will I be able to get an interview in Germany around the time I'm gonna be there anyways or will I have to fly down there just for that as they won't regard my wishes?

4. Does the removal of conditional status after 2 years apply for when I first came to the US as K3er or when I came with CR1? Kinda important to know when to send it in then.

I guess that's all for now, hope someone can help who has experience with this way of going about it.

1. NVC will send mails to the addresses in the I-130. You should inform them of any change in address.

2. You should inform them of your change in residence but also make them know that you wish to continue processing the I-130 at the consulate. If the NVC knows that a beneficiary has entered the US on a K-3, they will wait 30 days from the time they receive the I-130 petition to find out whether the beneficiary wishes to adjust status in the US to try to obtain an immigrant visa at the consulate. If after 30 days, the beneficiary hasn't inform the NVC of their wishes, the NVC will continue processing the I-130 as if the beneficiary wishes to continue processing it at the consulate.

3. You will not get an interview in Germany for CR-1 in one week. NVC processing for CR-1 takes 2 to 4 months.

4. Removal of conditional residency happens 2 years after you enter the US on an immigrant visa or status adjustment is approve. So if you choose to pursue CR-1, then you remove conditions two years after you enter the US on the CR-1, not the K-3. If you choose to adjust status, then you remove conditions after you complete adjustment, not the date you enter on the K-3.

1) The NVC will send an invoice for I-864 (affidavit of support) processing to your husband only. The NVC will send a package containing an invoice for the DS-230 (immigrant visa application) processing and a form DS-3032 (choice of address and agent) in duplicate, one to you and one to your husband.

2) The form DS-3032 will ask you, as its title indicates, what address the DoS should use to contact you. It will also ask if you would prefer the DoS to contact an agent who will act on your behalf rather than contact you directly.

3) You can ask. Consulates are usually more willing to delay what they would otherwise schedule as an interview date than the are to advance the date.

4) Removal of conditions should be applied for in the 3-month window preceding the 2nd anniversary of when status was granted. Thus, the date that you enter on a K3 visa is not relevant. The date that you enter on a CR1 visa is relevant, because that will be the date that status is granted. If the entry is after your 2nd wedding anniversary you will be granted IR1 status, without regard to the fact that the visa may have been CR1.

I'M doing the same thing, NVC send everything to the usc so dont worry,on the forms we have filled in while i have been here i have put this as my address!!, when you enter POE on your K3 you will get a A#,you can put this on the forms too!!

Erm, you get an A# at POE on K3? I don't think I did, hmmmm

Look at the back & under your I-94 you will find it there!! :P

Point of clarification: A# for the alien is created when the petition is submitted.

When petitioner or alien find out what the A# is is another story. It may or may not be on petition receipt notice, petition approval notice, visa, or I-94.

Hi everyone, thanks for your replies.

I already have my A# in my visa so that' s not a prob.

I just haven' t gotten the DS 3032 yet in Germany and I probably won't. Does this matter or can I just download it and send it in? Isn't there a barcode or anything I need to have?

Euro, I saw in your signature that you are also applying for AOS. ANy particular reason for this or just for EAD and SSN reasons?

Would be grant if you could answer me on that sometime.

I send a letter to the NVC saying that I'm entering on K3 but still wanna do CR1 instead of AOS and told them my new address. Hope that's okay.

I'm not doing AOS, I only applied for EAD so i could get my SSN as i have no idea how much longer my I-130 is going to be at NVC, we have just sent the last paper to them DS-230,so i might of wasted the EAD cash but oh well!!..........I didnt send NVC a change of address i just put this down as my address on the I-684 & the DS-230!!

as for the DS-3032 my husband just sent the one i had left at his house & he wrote our case number on the top right hand corner, this was accepted no problems!!

I thought you just did EAD but wanted to make sure. I'll do the same thing as our 130 just arrived at NVC a few days ago.

I guess I took your AOS as adjustment of status, not as Affidavit of support. It confusing that it's the same 3 letters.

Hey Germanangel,

I am doing the same thing too. The first couple of posts give you all the information you need to know. The I-864 and DS-230 have been sent to my husband, they have been here for at least 2 months now and we REALLY need to get them out and stop wasting time. They are almost finished and I have included a letter stating that my address has been changed to the same as my husband as I am now in the US on my K3.

I havent applied for employment authorization, I will wait to work until I have had my interview back in London.

Lets keep this thread going as it is very informative for us to share updates and for people who didn't realise that going home for the CR1 interview was an option.

Congrats on getting your k3 visa!

By the way, I have a 8-digit number hand written on the back of my I-94 (A-xxxxxxxx). Is this the A number that will stick with me and can I put it on my forms?????

If you indicate your A# on your further paperwork then it should dtick with you. If you don't put it down on the papers, they might give you a new one and you might be registered again.

I was told that it's the one that'll be it for now. But I could have been misinformed...wouldn't be the first time!!
