How many of us have been approved for the I-130 before getting the I-129F approved? What are we doing to do next, what are our options??

Please share ideas and pool information! I'm starting this thread so we can get together and do just that.

I would go for the CR/IR route. If you proceed with the K-3, the fee for adjusting status will be $1010 effective July 30.

Unless something has changed, it is my understanding that, as of 2006, because you filed the K3, USCIS will hold and not forward your I-130 to VSC, instead they will let your K3 proceed.

This was done to "help" us because the K3 is faster, so no use in wasting resources on both I-130 and K3 when K3 would generally win.

Instead they hang onto the I-130 to use it for AOS after your spouse enters the country on the K3.

To ask them to go ahead and process the I-130 you have to file an I-864 which takes up to 2 months for them to process. (and cost more money).

Credzba, I am wondering where did you find this piece of information because I did lots of reading and nowhere I found that USCIS will hold your I-130 if it's approved until the K3 is approved. My assumption was that you always have the option to proceed with whichever comes first. Please guide us to the USCIS source where you got this information or give us some more insight.

I don't think they will hold your I-130. Ours was not on hold...

Arrived U.S - October 3, 2007

My EAD was approved in 27 days

I don't think they will hold your I-130. Ours was not on hold...

I don't know if this is true for everyone, and maybe it is worth yourself investigating, to get an interview at our Consulate in Nigeria is extremely difficult for a CR1. I realize the NVC makes the appointments but they do so for approx. 10 months in advance. The K3 interview is usually held 3 months after they receive the info from the NVC. I have heard, it is US policy that all consulates/embassies are to replace the K3 scheduled interview with the CR1 as soon as it arrives. So the trick is to slow the CR1 down enough until the K3 makes it to the Consulate and hope the CR1 arrives before the interview.

Can we be penalized for letting both ride? What are the dangers in this?

This is what happened to me.......Not really knowing what I was doing I filled out what ever papers they told me to and I sent them in. As I went along Everything was going fine. When it came time to decide between the K3 visa and the I-130 I guess ......I was told I did not need to persue the K3.....the other one had already been approved. So I sent all the paper work to the the NVC office ......the Marrige cert. Birth cert. police record and all the other that is required. The end of June I found out that he was sechuled for an interview date for the K3 on July 3rd 2007. Well of course we did not have the papers becasue they are at the NVC office and they will not forward them or send them back to me.......So now they tell us we have to wait for the NVC office to schu. an appot. for the I-130 and I dont know how long that will take. The papers were completed and approved on March 12 of 2007........

You can consider yourself VERY lucky!

Wish that had happened to us.

K3 AOS and all ####### that went with it suck bigtime!

If I'd known what I know now I'd have done everything I could to get the CR-1.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Please please please when you do get your interview date let us know. The stats I've been reading about nigeria are not good in terms of the length of time it takes to get a CR1 interview in Lagos (are u going thru lagos or abuja?). From what I have read so far (and there is little information on VJ about nigeria and CR1's) it takes about ten months!!!!!!! I'm dying to know that this isn't true!

Please please please when you do get your interview date let us know. I will let you know as soon as I know anything.......when My Husband had gone to the interview date on July 3rd he told me that he met a man that is doing the same paper work as we are....His paper work was completed in Dec of 2006 so according to that it took only 7 months to get an interviw date but Im no longer keeping my hopes up........

That's what I thought is correct but recently I experienced totally different sceanario... my I-130 and I-129F was approved on July3 but both of them went to NVC and assigned to 2 different case One with DHK2007****26(K3) another 27 at the end... and My K3 already went to consulate and I just recieved a letter from NVC asking me to sent Affidevit of Support bill of $70 for CR1 case...

This is interesting. I do not understand why would they send you the $70 bill...
