Timeline

I wanted to say that we went to the infopass appt this a.m. and I think it was the best we could have done. The appt was at 8 but we arrived early so we saw an officer a few minutes before 8.

The officer was pleasant and I guess helpful.

We explained how we know nothing about our cases - and that I made an error on my husband's EAD application by stating we were applying as a fiance (and not along with the AOS). He immediately found my mistake on his computer once I told him my husband came in on the K1 visa.

He told me that he'd send the NBC an inquiry for them to change this code for us. I gave him the referral number I received from the USCIS Customer Service rep last week. He told me not to bother calling them - although he did want the referral number to send to the NBC. He said that CS only says to wait 30 days, or 45 days...

He said that he can only request that they change the code. I asked if the EAD could be denied and he said yes. However, since we're requesting the change BEFORE a potential denial we may be saved and the EAD may be approved - by next week even. If NOT then we have to reapply.

I then went to the office of one of my students because her office specializes in visas. Her boss told me how to reapply for the EAD (what to write on the application) and to apply for another EAD if we're denied or if we don't hear anything by next week.

The officer said that USCIS needs to decide on the EAD one week before the 90 days - and that it's not common to hear back about the EAD before the 90 days. Today marks day 79 for us since they count from when the the application is received, and NOT the NOA. That's better for us.

So..basically we have a good chance of being denied and a chance of being approved (if the officer in NBC decides to change the code). If we're denied we have to reapply and wait another 90 days. But, we'll do this before the 30th to avoid the fee increase.

The one thing the officer said that I know is not true is that it doesn't always take 8-10 months to be approved residency since I read that many people are approved in 2-3 months.

He said that if your case is sent to CSC then it's on a waiver and you don't need an interview.

Regardless, we'll be sending in the EAD if we don't hear anything by next Thursday. It could be a waste of money, but if our current EAD application is denied then we'll have another pending....just like our AOS.
