AOS apparently lost in mail...

Hello. Two weeks ago we mailed our AOS and now we have no information about it, we've called our post office, also the one in chicago and the 800 number and they have no info about it; my I-94 expires the 21st (saturday), so now what? will i be sent back home? also, if immigration does receive it, can i check my status using my old WAC number?

Jan 06/07............... We requested our Interview to be scheduled for January 22nd! my baby's bday! and he will be allowed 2b inside with me!! wow!

Jan 22/07............... VISA APPROVED!!! THANK YOU LORD!!!

Jan 29/07............... Went to cargo expresso to get my passport, which means: VISA RECEIVED!!!

Apr 27/07............... Married my one and only at 10;30am

Jul 06/07............... Finally mailed away AOS

Jul 19/07............... Check was cashed

Jul 21/07............... Thanks God we received NOA1

Jul 24/07............... Thanks God we received Biometrics letter

Ag 17/07............... Biometrics @ 12

Did you use a personal check, if so you can track it being cashed.

It took close to 2 weeks for our case to be received and the check cashed, so give it some more time. There was a holiday last week and may have stalled things a few days at the Chicago office.

And no they wont come knocking as soon as the I-94 expires, in fact many file AOS weeks, even months after I-94 expires, no problem.

The WAC number wont be used to track AOS you will get a new MSC number for that.

They're probably also taking longer than usual to send out NOAs, bank checks etc, just because they're no doubt inundated with applications as the fee increases are getting closer... try not to worry, just give it some time!

Oh, and no, you won't be able to use your old WAC number to track your case status - you'll get a new receipt number for your I-485 (and for I-765/I-131 as well, if you filed them) when you get your NOA, and will be able to use that. Although it will probably take a while for that number to get into the system - they seem to be a bit slow at updating it lately! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Did you keep a copy of what you sent? If you are unable to track your package using the tracking info from when you mailed it, you might send it again. You can't check your status online until you get your new NOA1 for the AOS, which will have your new case number on it. The WAC used before won't apply to this case, as far as I know. I believe you have to have overstayed your visa by 180 days without doing AOS before it becomes a deportation issue. But the main thing is to get your packet to USCIS. Good luck.

I assume since you think your package was lost that you didn't send your mail by the method that gives you a confirmation when the package has been received. Give the USCIS 30 days in order to send you your NOA1 (that is the minimum they usually quote when referring to how long it will take to get notices), if you have not heard from them by then maybe you could do an Infopass? Not sure if you have to have a case number for that or not as I've never been to one, or you could always risk the misinformation line. It isn't unheard of for an NOA1 to take more than two weeks, however, so no need to panic yet.

Thank you for your replies. Well, two days ago I went to the post office and they told me the package wont be delivered and to wait for it to be sent back, they didnt tell us any reason for it so, we decided to mail a second package, we were going to do so today but, we found out that the checks we mailed were cashed yesterday, what can we do now? I called the post office again and they have no info. How can we contact USCIS regarding this? how can we know we dont have to mail that second package?

Filed: Timeline

If the checks have been cashed then USCIS have the packet, so no need to resend anything.... they could not have cashed the checks if the packet had not been delivered....

You should get the NOA1 in the next few weeks..
