On July 16, 2007, we mailed a notice requesting additional evidence and/or information in this case. Please follow the instructions on the notice to submit the evidence and/or information requested. This case will be held in suspense until we either receive the evidence or the opportunity to submit it expires. Once you submit the information and/or evidence requested, you will be notified by mail when a decision is made, or if the office needs something further from you. If you move while this case is pending, call customer service.

even though it isn't what I was expecting, at least they touched my case. They haven't done that since march 5th.

Why it takes so long? what did they ask for reference?

Well Nessa, I'm glad that you at least have someone looking at your case...I know you said you were waiting forever.

07/2011 - Moved back to Brazil

But I thought the medical could be done after the AOS paperwork is submitted and brought over to the interview. That is wiered!

K1 applicants have the medical prior to entering the USA and if it is less than a year, don't have to do another one. If the medical is over a year, or they didn't do one prior to entering the USA, they do another one. (also they do another one if USCIS loses the original, which also happens)

If you look at the AOS info on the USCIS website, they tell you to include the vaccination supplement that you get during the medical with your AOS application, if you are a K1 or had one prior to entry.

Just a general question. Lets say you applied for AOS 6 months after you had your medical done as a K-1, if they take more than 6 months to process the AOS can they send an RFE saying the medical is expired even if you applied before the 1 year ??

And i am curious Nessa what RFE it is too :)

I was told to apply for AOS without a medical or a supplement, that we could do it while the AOS is being processed and take it to the interview with all the other paperwork.

No, if you apply for the AOS within 12 months of having done the medical, even if it takes 2 years to process the AOS application (as it did mine) then the medical results are still considered valid. If you apply for AOS after 12 months of having the medical, a new medical will be required. That is the way it is supposed to be, at any rate. I guess, though, they can always send an RFE if they lose the information or if the vaccination supplement wasn't included and they want to see it before the interview. I have heard of others who had to re-send their medicals even though they had a valid medical done within the previous 12 months, and that if they didn't send it, the applications were denied so it isn't good to ignore such an RFE.
