I-485 RFE for medical and I-129F

Well I've read some other's experiences on this one, but thought I'd question it anyhow... we got an RFE today on my wife's AOS.

Two things, proof of the I-129F petition, and the I-693 medical exam.... So right off the bat I know this is a crock....because,

with regard to the I-129F we sent a copy of the approval and it was listed on the cover letter. That's the easy part, I can send another copy of it.

But the I-693 medical. My wife had her medical in Feb 2007 as part of the K1 visa process. Per the I485 instructions, K1 visa applicants do not have to do a medical if within the past year, but send the vaccination supplement. We did that - we sent a sealed envelop from the civil surgeon who completed the I693A. It was even on the cover letter that only the vaccination supplement was being sent because the medical was in Feb 07.

So now, after reading other's responses to this, I wonder if we should just respond with the copy of the I-129F approval, and re-iterate that the medical was done in Feb 07, and per the I-485 instructions a new medical is not required and just the vaccination supplement and include another copy of it.

Suggestions? I know some of the obvious is to get a new medical, or try infopass or the congressman. Sheesh. We follow their instructions and still it goes screwy!

They are probably looking for the I-693A supplemental so if you sent it you need to try and find out why they are giving you an RFE on the medical stuff. Did the civil surgeon make you a copy of the supplemental? I am not sure if this can be resolved by filing an infopass but it possibly could. Maybe someone else will respond that has a similar experience.

As far as the NOA 2 for AOS, yes, send them a copy of the approval.

I had the same request for the medical. I went to infopass and was told that I could sent back the RFE with a letter informing them the medical is not required but they warned me that "No officer is going to approve a green card petition without a seeing a copy of the medical." Infopass did nothing for me so I contaced my congressman who called the USCIS. Within a week they found my husbands medical which was in his "other" folder.

The point is I woud be hesitent to just send back a letter stating the medical is not required, because if it really is lost your petition will not be approved. I'm not sure if they would have looked for my husbands medical if I had not involved my congressman and just sent back the RFE telling them to look for it.

Infopass did nothing for me so I contaced my congressman who called the USCIS. Within a week they found my husbands medical which was in his "other" folder.

I'm not sure if they would have looked for my husbands medical if I had not involved my congressman and just sent back the RFE telling them to look for it.

thanks, yes I read your posts on this. My wife does recall asking and being told the papers were being sent to Miami. So I wonder if Miami has her medical info. I'm ready to contact the congressman and perhaps set up an Infopass too. As the other poster asked, we do have our own copy of the I693A. The other oddity of this RFE is I did originally send a copy of the I129F approval and they're asking for that again too. The I693A was submitted in a sealed envelop from the local CS.

Geez, sounds like they misplaced/lost the file again. I see this happeneing to people on here over and over. If it turns out that this is the case for you, please report it to the Ombudsman. This needs to stop and Im sure if the Ombudsman gets enough complaints, something will be done. This is ridiculous.

Good move Christina. I'm pretty sure they would NOT have looked very hard if you hadn't gotten your Congressman involved. It's remarkable what can happen once a Congressman makes an inquiry on your behalf. :)

I'm of the belief that if you can get a Congressman or a Senator to make an inquiry on your behalf, then things will move along very quickly. But getting your Congressman or Senator to earnestly get involved with your case is another matter. Some Congressmen/Senators simply don't care. :(

yup, my thoughts too - I've drafted a request for my congressman to find the missing medical - we think it went to Miami. How they can "lose" the copy of the I-129F petition approval is beyond me!
