I 130 approved, I 129 STILL PENDING WHAT SHOULD WE DO?

Hi there,

I would like to get some advice, my I 130 was approved, I got an email notification yesterday, and on the other hand i still have my I 129F pending at CSC. What should I do now? My kids are on the I 129F, and their I 130 was sent just last month, because we thought if they still named on the I 129F it will be enough. Later, I was thinking that they will need to be in a way able to apply for same status as I do, therefore we sent their I 130 to CSC along with a copy of my Receipt of Notice from I 130 and I 129F. What it will be the next step? Can anyone help in this matter? Your answer will be highly appreciated.

My question was what should I do regarding the application for my children which are not yet approved. Therefore I can not imagine leaving them behind me. What do you suggest it would be better to do.

I might have read your timeline too fast because I now see the I-130 approval date. However there is still this.

I-129F NOA2 : 2007-05-23 NOA2 is an approval notice. Is this correct?

and this... Your I-129f was approved in 22 days.

As for your children, I guess I skipped over that critical part of your question. You can wait for the I-129F and follow the K3/4 path or wait for their I-130's to be approved and all come on immigrant visas. So that your I-130 doesn't jump ahead, I would simply delay paying any fees to NVC on your case until either the children's I-130's catch up or the I-129F is approved.

I would make the choice of agent, your USC spouse if they are in the US. If not, you can be the agent yourself. There need not be an attorney involved.

I might have read your timeline too fast because I now see the I-130 approval date. However there is still this.

I don't think I need an agent to receive and mail my forms, I know I will be my own agent. I did all that stuff with my husband, we talked about that yesterday night, and I have been browsing all the sites I could find, and forms, thererfore my decision is made.

I think my husband will call CSC tomorrow to see if they can make anything for the kids, the I 129F or the both forms of I 130. We will see. That way we will do all together.

Thank you so much for providing the link to james shortcut, I am really surprise how talent he was. Like Andrea, My I-130 petition is approved on July 3 2007 while I-129F still pending. I can't help but add the fact that just for the approval I had to wait 296 days for the I-130 (And I filed as an US citizen) As I was not getting the approval on anticipated time I filed for I-129F on March 2006 and still it is pending. Right now I want my wife here as soon as possible. I am interested in knowing that by following Jame's Short cut, how quickly I may able to have NVC sent the case to consulate(Once it goes to Bangladesh it takes only 2 week to get visa there). What happens if my I-129F get approved in the middle... can I switch to that in order to make the process faster??? please advice... Thanks in advance...

your time line is still providing us wrong info, which you should correct as it also will affect VJ's calculation of estimated approval in the future. I think you misinterpretted the Transfer Notice as NOA2, please Note: NOA2 means the approval notice, since you said your I-129F is not approved yet, you don't have any NOA2. The second notice that you got is just a Transfer notice which can not be considered as NOA2(Approval Letter). Thanks

The full NVC process using the shortcuts takes 60 to 90 days if there are no hitches. You won't have to do any switching if the I-129F is approved. It will continue at its own speed independant of your I-130.

My I-129F is approved and it seems like they had approved my I-129F on the same day they did I-130 but until July 6 I had no email nor even the Web portfolio registered any update date. As of July 6 I knew my I-130 was approved and in the NVC with a case #. After I got the approval email on July 7, I tried to contact the NVC live person, it took me a while to get the live person. I had been trying from 7AM till 11PM(EASTERN TIME).. finally at 11PM after a 12 min wait(which was not bad) I spoke to a live person who gave me the same case # when asked about I-129F and said it still in the NVC and didn't leave for consulate. Other VJ members reported their case(I-129F) has left NVC just the next day after receiving at NVC. Now My question is I-485 bill will be increased from July 30 as over Thousand dollars.. Would you please tell me if I still have to pay this I-485 bill while continuing with I-130 (IR-1) process... sorry if I sounded Stupid!!!

An I-129F and I-130 would not have the same case number. You reached NVC at 11PM Eastern time. Really?

If you continue with the CR/IR process you will not pay to adjust status. You'll pay the $70 each for the Affidavit of support processing fee and $380 each for the immigrant visa fee. However, you will need to wait for the approval of the Children's I-130s.

When you call about the I-129F, make sure you give them its case number and get the new Dept. of State case number NVC assigns.

Thanks for the update by the way. We've had a few reports of I-130s approved ahead of I-129Fs and have been wondering if the procedure changed and they were holding on the I-129s. At this point, my best guess on your case is that only the I-129F is at NVC. That's why they are giving you only one case number.

An I-129F and I-130 would not have the same case number. You reached NVC at 11PM Eastern time. Really?

That's sound unbelieveable right?? I was shocked when the automated system keep coming back on saying due to heavy calls it was routed to the Automated system again and it said call back after 6PM to till midnight Eastern Time to reach an operator so I started trying again from 10pm and finally reach one of them at 11!!! and surprised too...(I was so desparate to see the end.. ha ha ha). I already knew the Case No for I-130 when I checked the system with my EAC receipt. So when I reach operator I just gave her the info of my I-129F(MSC #) to see what went on with this... and she read me back the same number as I heard from automated system while provided the EAC#(I-130). Looking at the 1010 dollars of AOS bill and 3 months wait for green card I am now confused whether I should be more patient and continue with I-130 so that after she comes in we don't have to dill with all this fillings... and she needs to go to University as soon as possible too.... now could you please tell me if I choice to continue with IR-1, what should I do?? and if I just let you to decide (may sound funny...but just wondering about your suggestion) what you would do??

07-30 - Form is downloaded and deposited at the box asuming missed mail.

07-31 - Received Packet 3 and filled and hand carried to embassy by 08/06

08-02 - Emailed Embassy to know the appointment date

08-09 - Reply from Embassy Interview Sceduled on 09/17

08-09 - Requested through Email and resceduled the Interview on 08/27

08-24 - Collected Packet 4 in person and Medical Exam is done.

08-27 - Interviewed,Passport is kept and Given a Token to collect Passport with Visa on the next day.

09-04 - Visa in hand, 09-07 Ticket was booked to JFK for 09-10

09-11 - POE-JFK,NY :)) Finally got together after looooong time.

An I-129F and I-130 would not have the same case number. You reached NVC at 11PM Eastern time. Really?

That's sound unbelieveable right?? I was shocked when the automated system keep coming back on saying due to heavy calls it was routed to the Automated system again and it said call back after 6PM to till midnight Eastern Time to reach an operator so I started trying again from 10pm and finally reach one of them at 11!!! and surprised too...(I was so desparate to see the end.. ha ha ha). I already knew the Case No for I-130 when I checked the system with my EAC receipt. So when I reach operator I just gave her the info of my I-129F(MSC #) to see what went on with this... and she read me back the same number as I heard from automated system while provided the EAC#(I-130). Looking at the 1010 dollars of AOS bill and 3 months wait for green card I am now confused whether I should be more patient and continue with I-130 so that after she comes in we don't have to dill with all this fillings... and she needs to go to University as soon as possible too.... now could you please tell me if I choice to continue with IR-1, what should I do?? and if I just let you to decide (may sound funny...but just wondering about your suggestion) what you would do??

In think you should call NVC again and address the issue of case numbers. Ask specifically if your I-130 and I-129F would have the same case number. I've never heard of this. Let's verify first that you have two files at NVC and take the next steps from there.
