Got an email today that my I130 on behalf of my wife was approved on 5/31. The I129F/K3 still shows as pending. Does this mean now that I should abandon the K3 visa, or will this be put on hold automatically (as it would happen the other way around if I130 and I129F are approved at the same time)? Also, is there anything I need to do when the actual NOA2 notice arrives? I'm asking because I'm in Germany at the moment and had not planned on being back in the US until June 21st (i.e., about two and a half weeks from now).

Thanks for your help.

Wait out this week, you will probably get your I129 approved. How did you get your approval so fast, did you do anything special or do you have some connections. The reason I am asking is, if you didn't do anything special I can be hopeful of mine coming soon, because our timelines are similar.

thanks,

Nothing special. No connections. No idea. The ways of USCIS seem to be mysterious...

Good luck to you.

No, don't abandon your K3 and no it will not be put on hold.

You'll have to wait out the next couple weeks and see what happens, before knowing if your I-130 will be retained in Vermont. If it goes to NVC, you'll end up with two horses in the race and the possibility of a CR1 visa in a K3 timeline. If not, your K3 will proceed at its own pace.

What happens when both petitions go to NVC has been discussed recently several times.

Looking round the forum I couldn't find anything specific as to what happens if both petitions end up at the NVC. Could you please point me to the pertinent messages?

Thanks.

For now, don't cancel K-3. It may be approved very soon and go to the Embassy much sooner than CR-1. Usaully, CR-1 packet statys at the NVC for about 2-3 months whereas the I-129F statys at the NVC only for 1-2 week before it was sent to the Embassy. If both cases go to the Embassy at the same time, Embassy will cancel K-3 and go with CR-1.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

VSC is usually faster. CSC is running about 3 months from filing.

Thanks, everyone, for your input and good wishes.

However, my question whether there is anything that I need to do when the NOA2 arrives to keep the process alive hasn't been answered. If that's the case, then nothing would happen until I'm back in the US (I'm in Germany at the moment). I could fly back earlier if it's really worth it. Our schedules are such that we really would like this whole process to be finished by mid-September if that's at all doable. Therefore if getting things done earlier by about a week would really make a difference, I would fly back now.

Thanks for everyone's help.
