Request for Initial Evidence Today!! ARGGGG!!!!

Well... I feel so bad today... We received a "Request for Initial Evidence (I-485)", maybe the same of my friend Arazia, that say the following:

"(40) The sponsor on Form I-864 blah blah blah... must submit the following:

W-2's, 1099s and/or all schedules submitted to the Internal Revenue Services (IRS) - a copy of his/her Federal income tax return submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return"

I amazing because Araiza (another VJ user) and me already sent that with the original I-864, so this is something that is becoming normal in the USCIS? request something that they already have to delay the process???????

This is frustrating!

In the original package we sent the 2006 Tax Return of my wife (sponsor) so now what? Do I need to send the last 3 years? or just the same thing that I sent?? :help:

Please any experience with this will be good!

One thing is clear!!: If you get a TOUCH after the biometrics letter and before the biometrics appointment is almost sure that you will get a Request for Intitial Evidence! Like Arazia and me.

That happens a lot. You haven't any choice but to send the required information again. Until you do your AOS case processing will be halted.

Yep, that's the same RFE that my husband and I received. There was nothing we could do but turn it around and send out another copy of the W-2's. Maybe we ended up with the same bozo handling our case and he/she just doesn't know how to hold on to W-2's.

Tax return is the form 1040..

1099 is submitted when you are working as an independant contractor..

so submission of form 1099 with I 864 is optional and if only applicable to your case ..right?

I think there are many different versions of form 1099. We had a couple of different ones for my husband's tax return.

1099 also means the "additional income" like "bank interest" and other money u earned besides the income on your W2 (1099 B, D, DIV) . That is what they want and it is mandatory with 1040/ W2 and tax returns. It's not required if you are sending "TAX TRANSCRIPTS" from the IRS.

Well, I guess we screwed up. We re-sent our W-2's. I've never had to submit my 1099-INTs with my tax forms... or at least I was never informed that I had to. So I guess we're kind of screwed now.

Me too. Now I feel worst because My wife is traveling to India! and will return in 20 days. I want to re-send everything right now but I don't know anything about US Taxes forms.

This is what we sent and this is what I have to send with the RFE, please any recommendation will be nice:

Form 1040 2006 (U.S. Individual Income Tax Return)

Form 8863 2006 (Education Credits)

Form 3903 2006 (Moving Expenses)

But I don't have any "big or large" W2's of my wife, just smalls pieces of paper that say W2 (Wage and Tax Statement) but are very simple (is that?).

From the I864 form , page11:

"Checklist"

For ALL sponsors:A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statementand/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099,Schedule, and any other evidence of reported income. You may submit this information for the most recent three taxyears , pay stub(s) from the most recent six months, and/or a letter from your employer if you believe any of theseitems will help you qualify.

For SOME sponsors:If you are currently self-employed, a copy of your Schedule C, D, E or F from your most recent Federal Tax Returnwhich establishes your income from your business.

Yes, the W-2s are the little slips of paper. Just make a copy of those and include them with the packet. That is likely what they misplaced.

I read that when I sent my I-864 and we sent everything we have at that time.

But I still have the same doubt. I don't have any "big or large" W2's of my wife, just smalls pieces of paper that say W2 (Wage and Tax Statement) but are very simple (is that?)

I tried to call the IRS to get a copy of everything but they asked some questions that I don't know.

I too recieved the dreaded request for tax information that I was sure I had already sent. I made another packet and mailed it off today.

What was more disconcerting was the paragraph that said; You are ineligible for interim employment authorisation pursuant to (...) until ninety days AFTER the missing initial evidence is received.

I did not submit each and every 1099, nor did I submit any paystubs.

What I did submit was a copy of my 06 return with a summary of 1099 income I use as a schedule A. Let's see what happens....

Yes.

W-2s are narrow slips of paper that say W-2 on them. Do not submit the originals...just make copies of them to satisfy that part of the RFE.
