Hi All,

Is it true that when applying for a K-3 spouse visa, the husband and wife must have lived together for at least 30 days? Also, in India the requirement to get a registered marriage done, the husband and wife need to set an appointment before at least 30 days of the registered marriage. If the sponsoring spouse is a US citizen and cannot stay in India for more than 30 days then are there any other workarounds to get the registered marriage certificate? I read on New Delhi US embassy website that the American spouse can get a "No objection" letter for marriage certificate? Does anyone have more info about this?

Hi:

Where did you hear that huband and wife have to live together for atleast 30 days before applying for K-3. I got married on Jan 21st, our marriage was registered on the same day. I came back to US on Jan 26th. After reading your post, I am getting worried because I only stayed in India for 5 days after marriage.

Never heard of that, I have several friends on a different board that did K-3 through China and most did not live together 30 days either.

Hi All,

This is the first time I am hearing this. I know many people who married in India and lived there for less than 30 days and were able to get K3 visa. I was able to get marriage certificate in India even though I lived there for about a week after marriage. As almost everything in India, you may have to bribe the officials to get the marriage certificate faster but there is no requirement to live their for 30 days. The residency requirements only apply if one files directly at the Delhi embassy. Otherwise their is no requirement.

Never heard of that, I have several friends on a different board that did K-3 through China and most did not live together 30 days either.

It sounds like two issues are being mixed. US Immigration law does not require that husband and wife have lived together for any period of time.

Some countries have marriage registration regulations that require one or both parties to reside in the country or jurisdiction for a minimum period of time before a legal marriage occurs.

If your marriage is legal in the Country of marriage and you have the documentation to prove it, you are "married" for the purposes of US Immigration law.

Oh my God!!! This is scary. I am really getting worried now. I came back so quick because of my medical school. Does it help if I go and visit my husband before the I-129F gets approved. Even If I go i can't stay for more than 10 days. Or should I get some kind of documentation stating the reason why I could not stay with him for a longer time.

I am also little bit worried after reading that post. I cam back back quickly because of my college. I could go to India in summer but I am afraid that it is going to be extremely hot over there. So I don't know whether I should just go so that the embassy people are sure that this is legitimate marriage.

Visas are granted or not granted based on US Immigration law. There is no minimum time of living together. However, the Consular Officer conducting the interview will want to be satisfied with the evidence of an ongoing bonafide marriage. Most people do this by providing copies of communication, email or chat logs, proof of multiple visits etc. I expect the case in point had more to the story than simply 3 days living together. My wife and I were married on the Thursday and I left China on Tuesday. We had a second visit three months later for 10 days and lots of communication evidence. To my knowledge, nobody ever asked or calculated the number of days we were together in person.

I have two friends who married in China, spent only a few days together and never saw each other again until their wives came to the USA on CR1 visas.

I advise you to take a comprehensive approach to providing evidence your marriage is real instead of focusing on the number of days you live together as husband and wife.

On the website http://newdelhi.usembassy.gov/acsmarr.html, it says that "The procedure for a foreigner (e.g., an American citizen) to get married in India depends on whether the parties wish to participate in a religious ceremony or a civil ceremony. If required, the Embassy can issue a “no objection” letter to any American citizen who wishes to obtain an Indian marriage certificate." Is the "no objection" letter supposed to be given to civil court authority in India so that they can issue a marriage certificate? I am a bit confused about that process really works. Any insight on this will be much appreciated

I am not sure whether the "no objection certificate" is a requirement for the issuance of marriage certificate. In our case, the registrar came to the wedding hall, got our signatures and issued the certificate 2 days later.

I recently got married in India, It cost me about 5000 rupees to get my marriage certificate within a week. I also invited the marriage registerar to my marriage, he came with his papers, both of us signed them on the spot and he left to attend other marriages(I guess its a normal practice to invite the registrar to weddings ofcourse it will cost you few rupees).

About the US embassy, all they need is the proof that you both got married, not how long you lived together, marriage certificate, marriage pictures, affidivats by friends and family, any financial documents like life insurence beneficiary as your spouse, or her name on your bank account etc, any combination of these can be used to establish your marriage. I guess your friends wife might not have taken wedding pictures etc with her. So don't worry too much about not being together for too long.
