Oh, man, we were told this would be 2008 at the soonest. Oh look, they lied! Shocker!

I knew this would happen, but am sad to know that it's finalized because we'll be filing for AOS in July. Shucks.

Could you supply a link to where you saw that it has been made official?

Keyword is proposed. They havent even released the final fee changes yet. This news has been out since Febuary. As far as I know they havent said when the new fees are going to be put in place but It would most likely be at the start of the 2008 fiscal year which is October 1.

This is is in spanish but is from a serious News TV and Information channel (article date: April 27 2007) and said that USCIS finished with the feedback process of the fees and will be good (the new fees) from June 2007. I read the same thing in several other articles on internet, just google and see for yourself.

Nothing is official until it is posted here: USCIS FORMS

But as always, file the petitions before it happens.

This official proposal has not been officially accepted or implemented. It is still just a proposal. There is plenty of political opposition to it because it give the impression the USCIS wishes to balance its budget on the backs of the poor disadvantaged immigrant. I'm not saying I agree with that thinking, just that there is a lot of it out there among those that influence whether the proposal in implemented.

I've just taken a look at the I-130 form. In the PDF http://www.uscis.gov/files/form/I-130.pdf at the bottom of page 3 it says:

11. What Is the Fee?

You must pay $190.00 to file this form. The fee will not berefunded, whether the petition is approved or not. Do notmail cash. All checks or money orders, whether U.S. orforeign, must be payable in U.S. currency at a financialinstitution in the United States. When a check is drawn onthe account of a person other than yourself, write your nameon the face of the check. If the check is not honored, USCISwill charge you $30.00.

and as this form says it "Expires 11/30/07" does this mean that they can't change the fee after November?

I hope they can't change the fee for I-130 until after then, well I'll be following the fee details as listed in the forms. :innocent:

Yup, but the 60-day public comment period ended a month ago, so they can go ahead and adopt the proposed rule as early as 120 days after it was published in the Federal Register. It was published February 1, so it could go into effect as soon as June 1 -- three weeks from Friday.

The proposed rule, which can be found here, provides a lot of info. Table 12 has all of the fees. Table 8 is interesting because they average out all of the processing times.

Meh
