K-1 Visa after being Deported is it Possible

Dear Readers ,

I will first let you know about my storry ..

I came to the US back on december 2001 as student with an F1 Visa , and I was studing until 2003 ,oct 2003 I stoped going to college , what made me lose my Students status , then I met My Fiancé , For some reason I got detained my INS then Removed from US back to my Home country on Nov 17, 2004, ( the only reason that I got deported for is that I became Illegal ) I still Have clean Record ...

I lost contact with My fiancé while I was INS guest , after I went back to my home country I got in touch with my fiancé ,then she came to visit me in my country and we planed to get married , she didn't have the required document's so I told her to go back to the US and to find out if she can file the I-129f ..

This is the question do I have chances to have the I-129f approved , is there anything else that I can do .. do I have chances to come back to USA ..

I think you should do a search on "10 year ban". I recall reading here in these forums that once you've become "illegal" and they actually deport you then you are banned from re-entry to the U.S. for 10 years.

If I'm wrong I'm sure I'll be corrected in short order.

In the meantime you should do the search and read up on the details of such "bans".........

I would suggest your USC fiancée contact a good imm lawyer such as:

  • Ron Gotcher

ASAP, and ask to do a conference-call consultation with you.

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

2009/07/23 Pras files N-400

2009/11/16 My 46TH birthday, Pras N-400 approved

2010/03/18 Pras' swear-in

You may be eligible to file a waiver (I-212) to overcome the deportation

a lawyer is not necessary if you are willing to do alot of research

check on the USCIS website and also check at

wwwimmigrate2us.net in the waiver forums.

Yes, you can get a K1 visa if you have been deported.. However, you will need to obtain two waivers in order to get it. The first is the I-601 waiver to overcome your inadmissibility due to your ban. The second is the I-212 waiver to overcome your removal. They are filed at the consulate after you have been denied your visa due to your deportation.

These two waivers require specific legal advice. We have a forum here for these types of waivers. But these waivers need specialized legal advice as they must be worded in a proper way to be successful and how they are worded is specific to your own situation and the circumstances behind your removal. You can ask at our forum to get the names of some attorneys that specialize in waivers. In addition, there is a relatively mature I-601/I-212 forum at www.immigrate2us.com.

You do not need a lawyer to file a waiver

many people including myself have filed sucessful waivers without using an lawyer.....if you do feel the need to seek legal advice.....check to ensure you are dealing with a lawyer who is experienced in filing waivers, many of them are not.....a good one is Laural Scott....she holds an open chat on Wednesday nights....check over at www. immigrate2us.net she posts over there and also has a very good post in regards to filing your own waiver with tips on hardships etc. I have copied and pasted it here

I would strongly suggest you talk to a good lawyer about your case... you could file the waivers for it yourself but it's something that's much more difficult than just filling out some paperwork...
