Timeline

Hi eveybody,

Forgive me if I could have found this answer elsewhere. I remember reading that JFK is the only airport in the US that stamps the temporary work auth in the passports. I have a few questions about it. My fiance is considering changing his flight plan so that he comes in through New York.

Is it for sure that he can get this stamp? Is there any chance that he would be denied the stamp and flying in through NY would be a waste of time? Is there anywhere else I can read about this?

Timeline

JFK is the only one that gets reported to stamp the passport, though they can discontinue the practice at any time. DHS considers all K-1 to be work authorized by default, the stamp is only a courtesy that the POE does, to remind employers of that aspect of the K-1.

We came through the most convenient POE for us which was Chicago, my wife was able to get SSN and apply for a job by showing I-94, visa, and notices from SSA pointing out that K-1 has 90 day authorization by default.

My fiancee received the stamp in JFK and she didn't even ask for it. I think it would be worth it if the 90 day employment is important.

Wow, I was more clueless than I realized. So let me get this straight... My fiance can come in through any POE and still be able to work for 90 days, but JFK is the only airport to give the stamp? If he wants to apply for a job right away, he just needs to show I-94, and passport with visa? Or does he need to get a SSN card first?

Most employers wont hire someone with out a SSN, get that a few weeks after arriving in the USA, and all I needed to do is provide the SSN and point out the various pages on SSA website showing that K-1 is considered to be work authorized with or with out the stamp for the 90 days stated on the I-94 card.

There is a little more to it than that, but if you can get a logical person at the SS office, you will be fine.

Most of us had to fight the SS office for them to understand.

We came through JFK three weeks ago, we asked for and got a AED stamp on our I-94. However it was taken away when it was noticed that the name on the departure stub of the I-94 did not match the name on top. We asked for another stamp but we were told by the NEW POE officer that K1 was by default work authorised. We will see?

08/06/10 NOA letter received, but "Request for evidence" showing on the status website.

It is, that is without doubt. USCIS is in the process of trying to change the K1 to non-employment authorized.

The catch is that the employer is required by law to see a stamp that states "employment Authorized" on the I-94, or if you are lucky and as previously stated in this post, you get lucky and the people at the SS office give you are card that has no caveats.

Hi!

I changed my POE too this time (end of March). Usually I just fly into O'Hare in Chicago, but we thoght we will try and get my temp EAD. I walked off the plane and got my stamp in less than 15 minutes. I never asked for it. They were very nice :o) I guess the time element depends on how many people there are getting the stamp? Not sure. It was the quickest customs experience I've had...

If you haven't done so already, please add this info to the K1poelist. That would be great for people still using it as a resource.

Also... Dulles aparently still gives the stamp.

DISCLAIMER: this is IMHO. Others beg to differ (see below), and I will address their concerns soon.

For starters though, I agree that there appears to be no need for the JFK route or filing for a temp 90 day EAD:

the K1 Visa, I-94 without stamp, and your passport in order to work. In other

words, the I-94 is your temp 90 day EAD and yes, even without the token stamp from JFK.

Wrong. Please stop spreading your misinformed ideas around this forum, it will only confuse people. You're not the first person to think they've "cracked" the K-1 employment authorisation conundrum, and you won't be the last, but every one always ends the same way: accepting that you either need EAD or EAD stamp from the POE to work legally.
