A lawyer won't help you fix this kind of problem. If the package was returned, why would you need to spend another $190? Was the first check ever used?

And American people won't put your paper at the bottom of the list. If you file is in line, it will stay in its place in line. If it hasn't been submitted, it will be put in line when it arrives there. They may be slow, but they aren't vindictive at USCIS.

I'm not sure what this means: "Nothing on computer system they say there is 600000 visa applications waiting."

If you feel something has gone amiss, try contacting your member of congress or senator for help.

Can you explain your situation more clearly - then maybe we can offer some better advice?

I'm not sure what happened to you, but you said $190 down the drain... the I-129F costs $170 to file, if I remember right they'll refuse your check if you sent one for more than $170; could that be the reason?

There must be a specific reason why it was returned unprocessed. If you give precise details you are more likely to get meaningful answers on this forum. But as others have pointed out, there would be no reason to cough up the fee again.

If you paid by money order and have the payment stub you can contact the issuing company to verify whether or not the item has been encashed. If not, you can place a stop payment and start over. If it has bee encashed, ask them to send you a copy so you can get your case number off the back - that way you can determine what might have happened to your file.

I'm just very unclear as to what has actually happened here. Sounds like you sent it off, it was retuned to you fiancee and sent off once more? Help me out here!!

ok sorry about my lack of information but I have been really upset.

The end of January my american fiancee filed the 129F and the biographic information forms my boarding cards, photos and all the other stuff you need to send. She paid $170 with a money order she had no checking account although I had been asking her for months to get one she finally has one now.

Due to a mistake on the USCIS website giving wrong information our paperwork was returned corrected and sent back in an envelope provided by the Texas Service Centre.

This was sent about 4 weeks ago back to the Texas Service Centre.

After a few calls she is told that we are not on the computer system and that the case would be in the mail room.

My fiancee called today and was told there was no paperwork on system.

It can take up to 6 months for it to get processed and there is 600000 other k1 applications waiting to be processed.

The only option we can do at moment is to refile pay $190 dollar and make sure she pays my check and pray our paperwork comes up so that we can get a refund.

Its 3 months of my life waiting that have gone down the drain.

Im so down in the dumps.

Does she have the other part of the MO? That should have been kept for security purposes- its like a receipt. I lost a MO once and I called the MO company and got the money back w/in afew weeks.....they will stop a payment if it hasn't been cashed.

To Blessed to be stressed:) I realize that all things have a purpose and a time.....have faith and the Lord Almighty will provide... when the time is right, he NEVER fails!

If the package was returned unprocessed, it should have had the money order in it as well. If it doesn't find the receipt/stub/whatever evidence you can that it existed, then contact your member of congress or senator to help find out where the money went (trust me, the government always has a specific way of handling incoming money because they don't need to be accused of stealing when people already find the fees highway robbery).

But yeah, we need more info to help you out anymore than what we've offered.

It should have been transfered to the CSC if you sent it to Texas. Depending on when you filed, you probably should have received your NOA1 already. As previously stated, it sounds like you may need to contact your representative and ask for help.

Do NOT refile! You don't know what happened to yours for sure yet. Get some help first from people who have the power to help you. Then figure out what to do next.

It isn't wasted time yet. Go be proactive and then freak out after you find out the whole story!

No one here can call USCIS for you.

Are you the US Citizen? Whichever of you is the US Citizen needs to find out who his/her representative is (check www.house.gov for congress and www.senate.gov for the senate) and call that office and ask for the person who helps with immigration questions. Usually this person will be working from the District Office (as opposed to the Washington, DC office), so call there first - should be a local call too), so try calling there first.

Explain your situation and ask for help in tracking down what happened. They should be able to help you.

(if you can't find the right representative - either post a reply here or send me a PM telling me the zip code where the US Citizen lives and I'll look it up for you)

Wow. How bizarre. I am still a little lost in all this. First I would check to see if the money order has been cashed and if so, get the case number off the back of it. If it hasn't been cashed then stop payment. This is only the first bump in the road for this process. I too would be upset if my petition was lost. I didn't get my NOA1 for maybe 2-3 weeks when it seemed everyone else was getting there's quickly. Secondly, that operator you talked to has no idea how many petitions are pending, they guessed. Third, it would suck to refile, but if you love her and want to marry her, isn't that the better option as oppsed to saying 3 months of your life has been wasted? I am seeing so many red flags here. Is any one else? Give us complete and accurate details so that we can help you better.
