Submitting AOS package without NOA2 from K1.

Timeline

Alright, so Craig and I are planning on submitting the AOS package before the 90 day time limit on the K1 in order for him to stay in status. We never received our NOA2 for the K1 and are chancing it and will be submitting the package with our NOA2 email, print out from the USCIS Website, NVC Letter, as well as a letter explaining the lack of a NOA2. If they accept that, grand, great, fabulous! But if they reject the package, and we have to end up filing the I-824 and waiting for CSC to issue a new NOA2, will Craig still be in status while we wait to resubmit the AOS package? Also, if this happens, will any of it affect getting EAD?

Don't worry so much about the status thing, as far as I've ever seen on this forum people who filed after the 90 day window haven't had any problems with filing for AOS. You don't have to apply for another NOA2, you can just apply to get a letter from USCIS saying your petition was approved (I think the NOA2 thing costs a good bit of money) but sadly I don't know how you do this. I'd call the 1800 number or wait for another poster to hopefully shed more light on how to do this. I wouldn't file without it because that is a required bit of info and will most likely result in an RFE which can mean a delaying of your EAD (if you're filing for one) another extra 90 days from the day you've sent back the RFE since you're missing initial evidence (although, it doesn't always mean an extra 90 days, that's just what they say).

Oh, and on an unrelated manner, I noticed the "I think I love you" on your siggy and wanted to say that's what James said to me as well (all he said in the email, it was so romantic!) and we celebrate that day as our anniversary :) Well, before we got married of course.

Hmm, I know you can submit the I-824 for a new issue of the NOA2, but that costs $200 and can take 6+ months to process. I called CSC and talked to someone there, and he said there was nothing he could do for me unless I submitted the I-824. I asked him what the requirements were for issuing a new one, and they said only if the first one gets returned to CSC or if someone submitts a I-824.

I'm intrugied by this letter thing? Anyone shed some light?

Aww that's adorable! James said this to me after we'd chatted awhile :)

I know for a fact I've read about people getting just a letter saying they had an approved NOA2 and that they didn't have to go through the 200 dollar thing, I'll see if I can find out more (although search on here doesn't work that great!)

Hmm ok, looks like other people have actually just sent in online approval and NVC letter so maybe you'll be ok...I'm sure I've read something about them sending you a letter of approval though without having to pay for the official NOA 2 :huh:
