I hope someone can help me with this.

Here's the situation:

The current annual salary is bigger than the Last Tax Income and I'll be sending a Letter of Employment to prove that.

Still, the last tax income is just a bit over the Poverty G. Line.

Also, the form requests the past 3 year's income, and that is way down the minimum required.

For that reason I'd like to fill out the Part 7 of the form as the assets I would claim would make things look much better.

First question: Can I choose to claim assets even though I'm not REQUIRED to do so?

Second: I would only be claiming value of stocks and bonds, meaning line C of the Part 7.

Do I need to fill out line A (ballance of savings and checking accounts) and submit evidence of that too?

That's really not or I wanna do since those numbers are not impressive at all... :)

Can I fill out part C and leave A blank?

I really need your help for this.

From what you say , you show a marked improvement with your income with each consecutive year. In my mind that would be adequate, however, if you are insistent on showing assets , then go ahead and do so. What assets you show is strictly up to you. There have been regular discussions on this board concerning the offering of more information than is required. The consensus is that it's not recommended.

Also, if you are only sponsoring 1 immigrant and you have adequate income ,then form I-864EZ would possibly meet your needs.

I might do that..

If income exceeds 125% of poverty line then assets are not needed to be used. Only need assets to make up a shortfall in income.

I-864EZ is structured to use income only, that is why it is recommended if your income is sufficient. Also most recent year tax return data is all that is needed, though I have heard of people getting RFE for more years worth.

You can use tax transcripts instead of copies of (1040, 1099, W2). http://www.irs.gov/faqs/faq1-6.html

Current I864 only requires the ONE most recent tax return.

The new form requires you to submit only the most recent tax return, but it asks you to state the past 3 year's.

And I think I have to supply that information, even without sending a copy of the tax return of 2 and 3 years ago.

Is that correct?

You can give them whatever information you want to give them. The decision will be based on what you provide and document.

I wouldn't leave blanks. I'd put a squigly line through whatever fields you do not wish to fill out.
