Hello,

Well, after our consult with the lawyer, we submitted our I-130/I-485 package, and now I'm just starting to get nervous (even though I know it's too early to be nervous yet!). Can anyone tell me any reasons that the package would be rejected and returned to us, other than incorrect fees? The lawyer did check everything over for us and we made a few changes based on his recommendations, but I really want to be sure that the package will be accepted, even if we get an RFE later on. It just seems like we did everything so fast.

Timeline

We used a lawyer twice - the first time he didnt mail the package for 2weeks !

The second time I argued with him that a certain form needed to be submitted and he said no - so I said 'do you mind if i mail the package as i am going past the post office' and i did (without the form that he said was not needed )

It was RFE about 2 weeks later for the missing form

So dont trust lawyers opinions 100% and do as much as you can yourself..

anyway you have filed now so thats past the post - but i would say relax and an RFE might not hold it up at all as they keep processing the other stuff at the same time..

Its done now so yes relax and deal with it as it comes but pleasant surprises happen as well as glitches ...

Putting the AOS package together really isn't that hard. You basically transfer over a lot of the information used in the K packet. Probably why it feels like you messed something up.

#######! I did not submit the W-2s with my most recent tax return. I don't even know where the W-2s are. :(

I had seen a memo somewhere online saying that COs can request W-2s at their discretion if they feel that they need to question the tax return, otherwise they're not actually required. But I was reading another thread that said that someone got a request for INITIAL evidence looking for W-2s...so can they knock back the whole application if I didn't submit the W-2s?

But I was reading another thread that said that someone got a request for INITIAL evidence looking for W-2s...so can they knock back the whole application if I didn't submit the W-2s?

As far as I know, W-2s are required and also indicated on the I-864 form. Only if you requested IRS tax trascripts, then, you dont need to include a copy of W2.

You should expect RFE for W-2 copies...keep them ready and mail the RFE back next day to delay processing. :thumbs:

I'm not worried about an RFE; I can handle that. I just don't want the whole package knocked back.

Dont think failure to submitting W-2s leads to whole package being returned...they will just send you RFE for W-2s :)

Well there is the price of postage and it's probably feel better to know that your package is there being processed (even if t's temporarily on hold), then being shuffled back and forth through the mail system.

I'm not sure I understand this.

On hold is on hold. There's no processing happening when something is on hold.

Our package has been in their possession for 14 months. It's my experience this is no particular reason to feel 'better'.

You don't understand the positive feeling (that i am sure most people get) of having your package accepted and the process on its way?

Maybe I'm insane, but I am sure glad that my package is not sitting here unaccepted by USCIS and my AOS process still not started.
