Firstly. Which stage are you at in the process? Your timeline says consulate stage, and the application is for a K visa, yet you are mentioning the I-864???

I'm curious as to why the I-864 is being submitted? The I-134 is used for K visas. The I-864 is not used until your fiance adjusts status in the US. The consulate in Kiev also indicates the I-134 on its website in the packet 3 download. Have a look at the OF167. The packet 3 on the website also includes documents for the Immigrant Visa (IR/CR) and I wonder if perhaps this is where the confusion came in. Much of what is required by way of forms etc for the Immigrant Visa is also required for the K visa, however the affidavits of support are different..

I didn't think that money gotten from Financial Aid would count towards income....after all, it does have to be repaid, and it is not something that is counted as income on your taxes. However, I don't know much of anything on the subject so these are just my ponderings and what I vaguely remember about when I filed my I864 and had to consider the money I had from student loans. If I were you I'd read the instructions on the form, they should shed some light.

Ok, the instructions don't help much, but they do say that you can include house as an asset minus any loans outstanding on it, so that would lead me to believe that they aren't going to want you to include any "loaned" money on your I-864, but I'm of course not positive.

Not all financial aid is in the form of a loan. And not all income is taxable.

Only the equity in a home can be borrowed against or comes to the owner in a sale.

I didn't think that money gotten from Financial Aid would count towards income....after all, it does have to be repaid, and it is not something that is counted as income on your taxes. However, I don't know much of anything on the subject so these are just my ponderings and what I vaguely remember about when I filed my I864 and had to consider the money I had from student loans. If I were you I'd read the instructions on the form, they should shed some light.

From what I understand, the I-864 says that any means-tested government benefit received by the resident has to be repaid by the sponsor. If it's not paid back, the government agency has the right to sue to get it back. I'm assuming that financial aid is means-tested. That's not to say they are not eligible. Look at it more as a loan than a grant!

06/17/05: Check hit bank account.

06/20/05: All 3 NOA's rec'vd! TG!

08/02/05: Biometrics , New Orleans. Pretty uneventful.

08/09/05: EAD Approved!

07/12/06: ......still.........waiting.........

09/26/06: Case Status says interview has been canceled............What interview????

10/23/06: Interview finally scheduled for 12/14/06.

12/14/06: AOS approval pending renewal of Biometrics....Waiting on appt. for ASC!

Will this ever end????

01/17/07: Biometrics scheduled.

02/03/07: Everything complete at our end! Apparently my case file is under somebodys wobbly table leg.

02/27/07: Approval notice finally received by e-mail.....only 641 days!! 1 yr 9 mths!

The senario would be that the benificary applies for financial aid to study at a college. This would be after applying for AOS, will the sponsor be responsible for financial aid collected by the beneficiary?

Maybe. There might be some kinds of financial aid that come under I-864, but there are some kinds that do not. Talk to the people in the financial aid office of the school.

Perhaps you didn't understand the answers! It's explained in the instruction form for the I-864.
