Hey All,

Is there a criteria for transfers to the CSC office for processing? It seems the CSC office is processing Greencard faster. I reside in Alabama so my paperwork had to be mailed to the Chicago Lockbox and I received a NOA1 from the MSC center ... but I am praying for a CSC transfer. Is there a criteria or maybe there is no method to the madness?

Uh, actually, it's not just luck. I can't find my thread from several weeks ago, but after an exhaustive search on the subject, a found a letter posted by a VJer from a USCIS official explaining that cases filed at district office that are heavily backlogged and "not likely to require an interview" would most likely be transferred to the CSC. This included most of the offices in the Eastern region. That leaves the question, which cases are not likely to require an interview? Personally I believe that this may include K1s, since it would stand to reason that if the USCIS thought the relationship was real enough to warrant a visa, it might warrant a GC too.

USCIS doesn't issue visas.

I understand that. They approve the petition. The visa cannont be granted without the petition being approved.

and how is living in an area that is heavily backlogged not being *lucky*.. maybe we should all move to those areas - then it wouldn't just be luck :D

yes, there is a method to their madness, bottom line. my post was just being snarky in that there is nothing the OP could do to get trasnferred.

sarahsmiles did you have an AOS interview?

We did. It was crystal clear to me that the AO was not convinced just because we had an approved I-129F and my husband had been granted a K1 visa that he was free to pass us off easily as bonafide.

"Not likely to require an interview". Gee, how do they come to that conclusion. They never used that kind of logic before. Why now? Congressional oversight committee hearings coming up, perchance?

I'm not sure that I understand what this has to do with your interview...I was just listing a personal theory of mine that K1s might be amongst those they deem as not likely to require an interview. As I stated, it was just my own personal belief, not fact.

Maybe I'm not being clear.

It has always been the stance of USCIS to interview K1 visa holders. And the AO's take that responsibility seriously. I know that because I was interviewed and was subject to the scrutiny of someone I thought was a very skilled interviewer.

My point is that I don't understand how USCIS can suddenly deem some cases 'not likely to require an interview'. At least not without some formal guideline. It simply doesn't make any sense to me.

So is Cincinnati backlogged? :P I did search DOs to see processing dates but they all appear to be the same...I also tried to see who/where are the poeple living who get transferred & can't tell. Is there a thread on it or is it just being in the AOS forum for awhile that you get an idea?

Is it common for people to get interviewed when they are removing conditions of their 2 year greencard? I'm hoping that everyone who got their 2 year green card without interview will be interviewed to remove the conditions on it. Its the only excuse I can think of for USCIS not interviewing everyone equally.

i have no idea... i was commenting on the data sarasmiles suggested and the statement that there is more to it than being *lucky*... i disagree, while I DO agree there IS a method to their madness. I don't know what that method is.

That's the formal guidance I'm looking for and as far as I know there has been none.

It's oft been bandied about here that interviews would be more effective at 2 plus years into the relationship. There's probably some truth in that. But USCIS data shows that length of the relationship really has no bearing with fraudsters. Most can pull off a fraud for a good long while to gain the benefit of a greencard. They aren't going to backpedal and try to find another USC to start all over with. Might as well stick with the sucker they've got.

Gumaz,

I expect that there are criteria, I expect that it's highly subjective, and I expect that it's unpublished outside of the group at the NBC that does the preliminary processing of the I-485 cases.
