Help : 129F k-3 visa denied

I have just recieved letter stating that k-3 application has been denied. The reason given is that I failed to reply to one of the RFEs . But I never recieved any RFE via email. The processing date right now at NBC is mar 02, 2006. My NOA1 was in 2nd/3rd week of May

This isnt fair.

Is there any way to have them reopen my k3 application?

Also, the I30 is moving forward very nicely and I want ot continue this process. Will this rejection of k3 affect my i30?

Is it time for a lawyer?

The denial of the I-129F petition for the K-3 route is not going to effect the I-130 for the CR-1 process. They are two seperate paths to different visas. How far you are into the CR-1 path should determine if its now a waste of time to apply for it to be reopened or to refile.

How far along are you with the CR-1 and which consulate? Some consulates take a long time to schedule IR/CR interviews compared to the K visa. Do you know if that applies to you?

this is just very surprising

I worked at reopening our first (revoked, don't ask) case for 3 months, if that gives you any indication. Just trying to get USCIS to respond to me took 120 days. In hindsight those months would have been better spent waiting on a new app to process.

Did you move? is that why you didn't get your notice?

Married 12-30-05

Started our visa journey Jan 06.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

I-130

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-03-06 Packet 4 received

11-06-06 Medical

11-22-06 Interview / Visa approved

11-26-06 heading home, 6 day drive, my oh my

HOME SWEET HOME

10.24.08 - Mailed I-751 to CSC

Delivered at 9:03 AM on October 25, 2008

10.29.08 NOA1

10.30.08 Check cashed

12.06.08 Biometrics Appt.

12.19.08 Received new Drivers License extended to 2011

03.12.09 Received CONGRATULATIONS letter - Card on the way!!

03.20.09 Received his SHINY new card. WOO HOOOOOOO

YAY!! We can take a break from this madness until Citizenship.

I haven't moved. One reason was so this stuff doesn't happen. but my bad luck.

I didn't recieve any emails from USCIS either abt this rejection.

I have sent in my Aos form 868 adn sent in ds 230 payments.

My only worry is what my wife will say if the cousalate asks her has she ever been denied a VISA to USA. What explaination can she give?

The truth. Being denied a petition as in this case is not being denied a visa. They are two seperate things. You, the USC petitioner has been denied the petition. Your spouse wasn't denied the visa as she hasn't yet applied for it.

This is new to me as I never heard of it before. Do you have any idea how much longer? And also why longer? I've been on CR-1 boat and my file has been at the HCMC Consulate (Vietnam) since the middle of Sept. this year. I've learned that it takes from 3 to 4 months for them to schedule an interview and they do so in a first come first serve basis regardless of which type. But I'm still not sure what I've learned is correct...

Consulates vary. Mexico eg is a year, yet K visas are much quicker, Dominican Republic is a ridiculously long wait as well. Other consulates are on a first come, first served basis.
