Timeline

Hello;

My wife and I are applying for AOS and I would like to answer some quastions about travelling abroad:

1- Am I allowed to travel on the K-3 without AP since we are applying for AOS?

2-How long am I allowed to stay abroad since the K-3 is still valid?

3-Will the travel affect our AOS?

1. No. But you are allowed to travel on the K3 (until it expires) without AP since it is a K3 and K3s are multiple-entry visas.

2. Until the visa expires. But don't miss your biometrics appointment, AOS interview, or any other actions the USCIS might require of you.

3. Don't know - you haven't said anything about the nature of your travel or the bigger picture that the travel fits into.

Quastion 3:

Here is the nature of travel :

I was studying in Germany before I came to the USA, now I cant work or study before the AOS so me and my wife thought about me going back to Germany for the next two months to write the exams for this semester to get my associate degree.Do you think that this is an acceptable reason?

I have another quastion concerning studying, do I need a TOEFEL when i will become a permanent resident?

A lot of people leave the USA for several months at a time while their adjustment of status is pending, including my wife, and it caused no problem. Being away for study should be no problem as long as you're not studying at someplace like Al Quida U.

But why can't you study in the USA while your adjustment is pending? Or get EA and work?

A TOEFEL is not required to become a LPR.
