Can someone give me information on Affidavit of Support forms, etc for Montreal. Do they use the I-134. Where can I get instructions for it? How do I know who's qualified to fill it out for me? Does it have to be the petitioner, what if he didn't make enough.

A lot of questions!

  • First the instructions are included with the form. I-134
  • To determine if you make enough look at the poverty Guidelines I-864P I-864P
  • Yes The petitioner have to file it. If petitioner dosnt make the 125% poverty level in I-864P then get a co sponsor like a parent.
  • Yes they use I-134 for K-1 visa.

Another I-134 form and provide same financial evidence, typically Letter from employer, and past 3 years tax transcripts.

The co sponsor needs to make enough to make up the difference between petitioner's income and assets and 125% poverty line when counting petitioner, and beneficiaries.

YuAndDan,

No, the petitioner does not necessarily have to provide an I-134, especially if the petitioner is not going to be the sponsor. Only if the consular officer wants it for some reason.

A K visa is a non-immigrant visa, immigrant visa requirements do not apply.

Hold on - the co-sponsor only has to make up the difference between the petitioner's income and the 125% mark? I've always seen on here that if the petitioner can't reach the 125%, then it is solely the resposibility of the co-sponsor to demonstrate they can offer 125% of the poverty line for his/her own dependants, plus the petitioner, beneficiary, and any of their dependants. Which is it - the co-sponsor and petitioner combine, or just the co-sponsor?

That's not correct. I-864 Joint Sponsors must satisfy the PG on their own.

There is no such creature as a "co sponsor".

Joint Sponsors never need to include petitioners unless they are household members (or the rare instance of a petition/dependant).
