I-864 Question

Hello,

Anyone can elaborate on whether NVC considers the income for the whole 3 years for the I-864 or the most recent years. My dilemma is for the last 2 yeears I have been making well over the poverty line, but in 2003 I only filed $7000, because I was in college and not working. As of now I have a permanent job which pays well above the requirements.

Any additional info... will be highly appreciated.

About 5 years ago I brought my ex over on a K1, and only the last two years were above - just like you. The second year was VERY close even...but the most recent year was fine. It never came up. You should be ok.

The NVC does not consider - the consular officer processing your visa application does the considering.

The most important concern is your current income.

Last call to Immigration said that we needed only the last tax return. I asked about the 3 yr history and they said just use the last one.

By current income, do they look at both the previous years ITR and my current job? Im sort of in the same situation, i went to school last year and only worked part-time and made around $12,000. My current income for this year is well above that.

I do have the last 3 years ITR's along with my employment offer letter stating my yearly salary and paystub showing my income YTD. Would that be enough, or should i go ahead and get a co-sponsor to be on the safe side? Thanks in advance.

The current requirement is the most recent year's tax return. The Embassy will take a look at the most recent year's tax return. Can you get a co-sponsor or is it too late. Worst case, the consular officer will ask you to get a co-sponsor and submit it to the embassy.

Erik,

The current income is your last pay check, for someone who has steady, fixed employment. (Not self-employed, not temping or a contract worker, things like that.) Last year's tax return may (or may not, as in your case) substantiate that the current income is ongoing and sustainable.

As someone who has a very short track record, I think it would be prudent to have an I-864 package from a Joint Sponsor that you could submit if your's is determined to be inadequate.
