before applying for K1

Hello everybody,

I've just finished reading the information on how to apply for K1 fiance visa. I am naturalized USC, living in the US. Two questions:

1. Do my girfriend (living in Romania) and I have to be officially engaged to consider filing I-129F?

2. Do the documentary proof have to be included with the initial application?

You do have to have intention to marry (and provide statements signed by each of you). I don't know what you consider "oficially engaged" - engagement ring?, party? - I don't know.

You have to include proof of having met within the past 2 years.

Just like Mew said, proof that you've met within the last 2 years. Also, proof you have an ongoing relationship would be good - Letters, e-mails, etc. If you've met within the last 2 years then pictures would be good. Hopefully you've taken trips together - tickets, hotel receipts, restaurant receipts, pictures of the trip etc. Good Luck.

Proof of ongoing relationship is not really required at this point, but some Vjers advocate it's okay to send it anyway.

Pictures showing the 2 of you are secondary evidence, so you should send more than just pictures (date them on the back - some VJers have gotten RFEs for that). When you describe the circumstances under which you've met in person (Q18), give a brief description mentioning where, when, what you did and support such description with evidence, as Arnold and Joan said - pictures, tickets, receipts, visa stamps on the passport, etc.

You may be able to marry in Romania, file for her as a spouse at the Consulate and have her return with you (or shortly behind) where she will enter the US as a Permanent Resident.

This is not available everywhere, but there is a very strong possibility that Bucharest will do this.

Proof includes third-party verified items (primary evidence) like passport stamps, boarding passes, rental receipts; something that some other organization did and left a paper trail. Photos, letters, e-mails, and the like are secondary evidence that can't stand on its own, but can help create a picture in the adjudicators' mind that yes, this is a real couple with good intentions.

Most people send a combination of primary and secondary evidence. The K-1 guide makes some suggestions on how much to send.

We got told from TSC both of us to write a statement about we are intend to get married within 90 days after I, Rico (the benificiary) will enter the US.

Also add as many evidences of your have met in peson within the past 2 years (pictures, flight tickets etc).

Concerning what you call an official engagement so they don´t ask for anything like that.

I think I certainly can get married without I had to be officially engaged for several months or years before.

That´s really nobodies business! Not even for the service centers of USCIS.

2. The US Consulate in Bucharest states te following:

"At many U.S. embassies and consulates that do not have a USCIS representative (including Bucharest), USCIS has granted consular officers limited authority to accept I-130 petitions. If you (a U.S. citizen) normally reside in Romania, you may file the I-130 petition at the Embassy's consular section, rather than with USCIS in the United States. If you do not normally reside in Romania, you may file the I-130 petition at the Embassy only if you are physically present, there are emergent or humanitarian concerns or U.S. national interests for accepting the petition, and the petition is clearly approvable. In order to file the I-130 petition at the Embassy, you must request permission in writing, explaining how your case meets these requirements. The Visa Unit Chief will review your request and respond within a few days. You must include the following information in your request:

Your full name, date and place of birth, date of naturalization (if applicable) and normal place of residence;

Your spouse's full name, date and place of birth, and normal place of residence;

Have you recently naturalized? Have you been separated from your love due to your status? Being newlywed may be sufficient as I remember it.

I actually dont' know how strict they are about that way of requesting.. Other people have reported that they did not do anything special.

You will have to do some digging for experiences--the VJ archives are gone now and I didn't save all the stories that I wanted to.
