Timeline

So I spoke to the guys at NVC and was told that since my I 130 has already been approved my I 129f Petition is being sent back to the USCIS and is considered closed now. They did assign a case number for my I 130 as well as I 129f though. Hoping to get the choice of agent form in the email sometime soon.

Nope No children. Actually it works out for me that we will be married two years on March 9th 2010 so hoping she will get a 10 year GC. So no more contact with uscis till three years after that when she applies for her citizenship.

NVC:
04-29-2010: INTERVIEW ASSIGNED FOR JUNE 10TH IN CHENNAI CONSULATE, INDIA; 06-10-2010: INTERVIEW - VISA APPROVED!!!!!
06-18-2010: Entered US - NEW YORK CITY and 08-16-2010: GC received! (nearly 2 months after PoE) woo hoo!
AOS for permanent 10 yr green card:

04-02-2012: NOA of I-751 and 1 yr extension of temp green card

05-03-2012: Biometrics appointment

I'm not sure, but I think if she enters America after the 2yrs anniversary she gets the 10yrs Green Card.

Guys, I think you are reading too much into it. It says the petitions have to have arrived at the same time for them to close out the K-3, does it not?

The reason I say this is because I just recieved notice from BCIS that they sent my approved k-3 petition to NVC. My CR-1 is still at the initial review stage at BCIS Vermont...and I sent that in a month earlier than the K-3.

Guys, I think you are reading too much into it. It says the petitions have to have arrived at the same time for them to close out the K-3, does it not?

The reason I say this is because I just recieved notice from BCIS that they sent my approved k-3 petition to NVC. My CR-1 is still at the initial review stage at BCIS Vermont...and I sent that in a month earlier than the K-3.

USCIS is still forwarding the approved I 129f petitions over to the NVC, ..... It is the NVC which will close an I 129 f if the I 130 for the same beneficiary is approved alongwith or before the I 129f. It will not apply in yr case though cause it seems yr I 130 is still under process at the USCIS.

How do you figure this is such a "smart move"? Based on this scenario, what would be the best course of action:

Canadian citizen lives in Surrey, BC, 9.64 miles (18 minutes) from the US border.

Canadian citizen works in Burnaby, BC, 10.28 miles (24 minutes) from the US Consulate in Vancouver, BC.

US citizen lives in Ferndale, WA, 14.69 miles (17 mintues) from the Canadian border.

IR-1 interviews for Canadian citizens can only be done in Montreal.

K-3 interview can be done in Vancouver...again less than half an hour from where the Canadian citizen works.

Factor in the cost of a plane ticket from Vancouver, BC (where there is a perfectly operational consulate mind you) to Montreal, PQ.

Factor in the cost of a hotel stay in Montreal, PQ (7 1/2 hour flight time including time zone changes nearly eliminates the possibility of having an interview date the same day as the flight).

Factor in the cost of meals.

Factor in the cost of transportation from hotel in Montreal to US Consulate in Montreal.

Factor in the lost wages of a minimum of 2 days away from work. I know this may come as a shock but the consulate is not open on the weekends.

Factor in strong desire to NOT travel to the province of Quebec....EVER.

Tell me again why the IR-1 is such a "smart move"?

I don't see that it is and so to all the morons that say without a qualifier that the K-3 is obsolete, you can GO TO HE'LL!!! (Or Quebec....same thing)

The major advantage of an IR-1 here is that they don't have to file for AOS and they don't have to file for removal of conditions...a lot of money, paperwork, and time saved in the long run.

I'm fairly sure I read that the starting date was 02/01/10 so you may have just missed it :( I would definitely try calling the NVC about it.

Yeah, I would call and see what they say, for some people the K3 doesn't seem so obsolete as other so often put it. It is a good choice for certain people in certain situations. I am glad that we were approved just before the new policy went in place, but maybe they will still let some people choose if they call about it. Who knows. It's worth a shot anyway if you really want to follow the K3. Good Luck!

I can't see any good reason for the K-3. Some people say it's better when children are involved for the K-4 derivative, but you will still need to pay $1010 X2 for AOS, Still doesn't make sense. K-3 was implemented 10 years ago with the LIFE act when it was taking 2-3 years to adjudicate CR-1/IR-1 visas. That time difference is basically gone.

I have seen so many stories here with K visa folks. They get here, they can't drive, they can't work etc. etc.
