My wife is home we have gotten past all the Adam Walsh regulations, and my wife is in America. We can be a happy family. We enjoyed our new baby together on Thanksgiving day. Our first Christmas together and the New years. We just recently moved and i happen to be going threw some of our immigration paper work. I came across some Immigration information that was handed to my wife at the second interview before she left Colombia.

I was not aware of this information up until a few days ago. My wife seems to believe it was by accident the consulate passed this to her with other paper work. It was the ADAM WALSH RISK ASSESSMENT SHEET.

It contains what they are looking for to be able to determine whether to issue a approval or denial. It was in this category exactly in a check box segments.

RISK/No RISK DETERMINATIONS

1) One side was this statement- The nature and severity of the petitioners specified offense(s) against a minor. My charge and conviction at sentencing, probation etc.

2)The petitioners criminal history- No arrests since first conviction of sex offense.

3) The nature, severity, and mitigating circumstance of any arrest(s), conviction(s), or history of alcohol or substance abuse, or any violent behavior, such as domestic abuse or child abuse.- No violent behavior or abuse history

4) Will the petitioner and beneficiary be residing together.-

This next statement seems to be the most important I feel.

5) The degree of rehabilitation or behavior modification that may alleviate any risk posed by the petitioner to the beneficiary, evidenced by successful completion of appropriate counseling or rehabilitation programs and significant passage of time between incidence of violent, criminal, or abusive behavior and the submission of the petition.

comments to this question about me was this, 12 years have passed. successfully completed treatment and currently has full custody of my two sons. letters and polygraphs saying no other victims since completing probation 12 years ago.

I hope this can help others in the situations of Adam Walsh petitions. Again this is the Adam Walsh risk assessment sheet they use to grade you during the intent to deny.

Great information! Hope I get approved , sometimes it feels so hopeless =/ I should meet these requirements

I first read about your success against the Adam Walsh Act about a month ago, and to say the least, I am very happy for you and you wife! Your story has given my fiancee and I renewed hope.

Perhaps this isn't the place for an introduction, but if I hadn't read about your success, I wouldn't have joined this forum. I met my fiancee online over 4 years ago (2005) while on parole. The second time we spoke I told her everything. After completing 3 years of parole successfully, one of the first things I did was get a passport and visit my fiancee in the Philippines. We had waited 3 years for this, and it was wonderful. We put off getting formally married because we thought it would be better for immigration purposes if we did that in the U.S. When I had to go back home, we consoled each other with the knowledge that she should be in the U.S. within 6 months.

My brother had married a Brazilian woman and gone through the K1 process, so I contacted his lawyer and sent payment right away. Not the cheapest lawyer, but I didn't want to mess around. The lawyer sent the paperwork packet and I began on it immediately. Only then did I find out about how the Adam Walsh Act affected our Visa process. The lawyer believed the only real chance I had was a constitutional challenge that would cost much more than I could muster. Needless to say, I was crushed--both of us were, but I have to say she was stronger than I. I got my money back from the lawyer. Every time I researched online the situation looked bleaker: people waiting for years without response. Nevertheless, we have been determined to stay together and hope that God would work something out somehow.

Now that there appears to be hope notwithstanding the AWA, I find myself unemployed, layed off along with almost all of my coworkers. I don't know how that affects the K1 process, but I'm sure it's not good, and I'm sure the answer is somewhere on this forum.

Anyway, thank you and everyone else on this forum for sharing your experiences with this contrary law. I pray that God would bless you and your fiances/fiancees/spouses.
