Help!!Wrong Data on Green Card, who's Fault is it?

Hello fellow VJ members,

In connection with my other post about the wrong data in my 10 yr. green card,, some said I need to file I-190 for correction of my green card.

The fee is $370 and some said if it's their fault for the clerical error then i do not have to pay for the fee. My 2 yrs. green card is correct but my 10 yr. green card is not.

My correct name is:

First Name ---Maria

Middle name/single name---Llamera

Married name--Smith

The 10 yr green card shows:

MARIA LLAMRA SMITH ( letter "A" is missing)

My questions are:

1. Who's fault is it that my green card is not correct? I did sent them a copy of my 2 yr. green card, old and new passport and other documents with correct spelling?

2. SHould i pay the I-90 fee which is $370.00?

How can i convince them that it is not my fault for the clerical error in my card?

Please please i would appreciate your help.

Thank you so much can anybody here tell me how to make an infopass appointment? Never done that coz ihad no problem since first day of my k1 process ,,not till now i got my 10 yr. green card.

Please i would appreciate your help.

Like I said i never had a problem since day 1 in my K1 process.. and also i just checked all the photocopy of documents i sent them when i filed my Removal of condition in July 2009.

I remember they have it wrong in my biometrics notice and i am 200% sure that when i had my biometrics I told the person who did my fingerprinting that the notice i got was wrong and i even entered my name and everything in their computer myself to correct the error in the notice but still My green card appeared wrong? Can anybody tell me how to make an infopass? Thanks a lot so much to all.

Do you have copies of your I-751 form showing that you spelled your name correctly on there? When I had to file an I-90 I made an Infopass first (so that I could get the I-551 stamp), and the officer made a point of looking my "stuff" up in the system - from what she could see (although I have no idea what that was), she seemed satisfied that it was their mistake and not mine that led to my incorrectly-spelled green card. I also showed my NOA for the I-485 application showing the correct spelling, and had copies of the forms in hand to prove that I know how to spell my own name. Whether it helped or not I have no idea, but she did note something down somewhere in "the system" before giving me my I-551 stamp to state that I'd be applying for a replacement green card due to USCIS error. When you send the I-90, send a cover letter stating that you're filing for a replacement with no fee due to THEIR error, and send copies of evidence to back this up.

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

Seems to me the, the letter "E" has been omitted in your middle name. May not be a big deal if everything else is correct, like your photo, fingerprints, and dates, but would ask about it anyway. If applying for the N-400, would definitely make several copies of it.

Can't recall at what time you have to get up in the morning to make an infopass appointment, always full during the day, they switch at sometime between 2 and 5 AM in the morning where cancellations have been made, a pain in the butt for sure.

We sure had our share of typo's in particular when departments switch over to a computer data base in important documents, Venezuela was extremely expensive, Illinois wasn't, but sure required a lot of proof on my part, think Illinois hired a bunch of second grader's to do the transfer, error after error.

Wasn't there something that came in with your green card in case they made an error?

do not pay the additional fee.

the proof that the error is theirs will be your copy of 751 submission and your copy of 2 year card, as well as AP, EAD, and anything else you had earlier received with your name on it.

Make an INFO PASS appointment online...to discuss that mistake with a USCIS officer before filing I-90 to ensure you know the party (either you or them) who committed the error by showing your documentations to them. And then after that, file an I-90 either online or paper submission/mailing.
