We're in trouble please help!!

Timeline

So, I petitioned my husband and had an interview in Juarez in 2007. He was denied thanks to me. I filed all the paperwork myself without going to an attorney. I told my husband that he just had to be honest in his interview. Well he was; when asked if he had ever used illegal substances he said yes. Now I know that sounds bad, but he was in high school when this happened. In my opinion it was an unfair question. He is a totally different person now than when he was in school. We have a kid together, I am a registered nurse and he was going to be a police officer. But now all our dreams are shattered. I thought there was no way they would deny him. He has never been in trouble, not so much as a speeding ticket. He was brought by his mom as a young child when she fled her abusive husband. Well point is that he was told he could re open his case in 3 years which is this october. I am going to contact an attorney within the next couple months but I wanna know if there is any chance he will be forgiven. Please tell me what you think.

I second the recommendation to visit www.immigrate2us.net This isn't an uncommon situation. The ban for using drugs is supposed to start from the last date of use. So, if he did drugs 2 years and 8 months ago he would not be eligible for a visa for another 4 months. If the drug use was many years ago and there is no evidence that he is/was a substance abuser then the ban should not be there. The problem is that the ban seems to be applied rather inconsistently. Some get 3 year bans from the date of a recent use and some get 3 year bans from the appointment date even if the drug use was many years ago. Proving rehabilitation during the ban is essential, but it cannot get you out of it altogether.

Unfortunately, your chance of being "forgiven" are not very likely. It's one of those bans that cannot be waived until he does his time so to speak. You should still contact a very qualified immigration lawyer to see exactly where you stand though. There may be someone they could contact but don't get your hopes up. www.scottimmigration.net www.humanrightsattorney.com www.lizzcannonlaw.com www.amschwartzlaw.com are all very good choices in these and other inadmissibility cases.

You say your spouse was brought by his mom as a child. He was unlawfully present in the US? If so, he will still have to file a waiver of inadmissibility after the 3 years is up assumin he left some time after his 18th birthday. Were you aware of the need to file a waiver because it's hard to tell from your post.

Please go to www.immigrate2us.net and talk to member "D" she is a moderator there going through the same situation. She recently found another case just like hers and yours on the Juarez forum which was found eligible for a waiver after the 3 years and approved through the "pilot" program.
