i want to bring my daughter here in the states too

hi fellow vj'ers...its been awhile since the last time i was here...but nways,im in the states now for a month n a half n everything's doing fine well except for the fact that i miss my family so much specially my daughter....

n my problem is this....i have a child from a previous relationship....she's still in the philippines right now......n me n my hubby are planning to get her soon n bring her here so we cn be together,,,anyone had the same situation? what do we have to do? my daughter is being taken care of by my mom n i dont know where her biological father is at right now....pls i need help......

If you came to the US on a K-1, then your husband can file for a K-2 visa for your daughter.

If you cam to the US on a CR-1, then your husband can file for a CR-2 visa for your daughter.

The US Embassy will not issue a visa to your daughter until you get the notarized quit claim from her biological father allowing her to immigrate or a court order allowing her to immigrate. You telling that you cannot locate the father is not an excuse for obtaining the quit claim or a court order because it is too easy for people to lie about not being able to locate a biological parent in an attempt to circumvent this requirement. The US government will not take part in assisting a parent in removing a child from his/her home country without the other parent's consent. The concern is international child kidnapping by a parent.

Hello there,

I have a similar situation with eimen05. I'm not in the US yet --but my US Citizen husband is planning to petition my 7-month old baby as well (my USC husband is not the biological father).

I was never married to my ex, did not acknowledge him as the father as he abandoned us prior the time I gave birth, and I did not include him in the birth certificate.

My question is: Do I still need the "notarized quit claim from her biological father allowing her to immigrate" despite my situation?

same answer. you need a release from the biological father. this is part of an international agreement that has been law for some years.

resist the temptation some others fall into to provide a falsified release. such action can result in legal trouble that will bolix up the entire process.

the bio father will hear where the child is, you will be blackmailed, and you may end up in jail in one country or another.

This information will be requested at the NVC stage and at the interview ( maybe )

Why is it that the only one who can stop the crying is the one who started it in the first place?

Immigration won't 'ask' .

It's up to the USC to provide the info, and the proper info , during NVC processing of the I-130.

I'm sorry, but I keep noticing pattern of 'ask' when it should be 'provide'.

What are you thinking?
