Honestly I do not think it will affect anything, your sending her your income paperwork. Owing the government again in my opinion should not bother your case. If I am wrong someone will correct me, but I have never seen a case interrupted due to owing the government money.

I just recently received a letter from the IRS that I owe them some money. Would this affect my petition, my fiance is scheduled for an interview soon and I am about to send her my income document.

It might be a problem if you had an IRS levee against your property or something due to owing on back taxes. But its not against the law to owe money. Owing the IRS tax money will not affect your petition. The only place it might matter is when you filed your AOS I-864 and your tax debt put your income status below the poverty line. But you know one can always work out payment arrangements with Uncle Sam.

My case is a little different since I was IR-1, but here's what happened to me. I was barely over the 18k for 2007. I owed 10k to the IRS for 2006. Somehow the embassy knew about this and subtracted what I owed the IRS for 2006 from my 2007 income. They would not give my wife the visa due to this and gave her 221g. This put me below the poverty line of course. Luckily my 2008 income was way over the limit. I submitted my 2008 income tax along with copies of my W-2s/1099s.

They said I had a tax lien which is odd because at that time I was on a payment plan with the IRS, and had been making payments every month on time.

As long as what you owe them will not put you below the poverty line, then you should be fine.

OK thanks for further explanantion. You might want to contact the IRS and get a letter from them showing you have an agreement and are in compliance. This document could prove valuable in the future. I had a tax lien once but not during my K1 process. I know what a headache it can be especially if the IRS puts the information out to the credit reporting agencies - then everyone can see it. You bring up another interesting thread for a different topic - how connected is the USCIS and the IRS?

It was weird. I went through USCIS, NVC etc. It never came up until the interview, which is really odd in my mind. I kinda disagree with the highlighted statement above , because I was on a payment plan, and had the lien lifted. Best to plan for worst case scenarios in this process.

IMO, you'll be ok until a tax lien is levied against you.

So, handle your business immediately - that will mean - either:

1. pay in full - or

2. have an agreed payment plan.

Now, if you've been 'levied' - I dunno, that's some gray area - and I really don't know if things will stop.

I have heard of people with tax levies having their passports taken at any border control point, but that won't be the case for your fiance - it's your responsibility, not hers.

Remember - name checks occur at every stage of this process - so if something 'new' pops up at the Consulate, well, you've waiting too long, IMO, to handle yer tax issue.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I guess i wasn't clear enough. I had a payment plan. The lien was removed. It still caused problems. Better to take care of it now than get a surprise at the embassy.

Ah - I see now, where I missed something...

It's possible to have 'payment plan' with the IRS WITHOUT having a tax levy in place.

You had a levy WITH a payment plan. Got it.

Ah - I see now, where I missed something...

I still don't get that. I had an agreement with them, but still had a levy. You would think they would remove levy once you make an agreement. Apparently not. Hard to figure them out.

daboyz - there's a lot of 'variance' on this stuff.. can make different combos, you betcha.

in the end, if a levy is made, it does take time to get it all sorted out. I'm hoping the OP can get it sorted out before a levy is made.

I'm guessing that the levy wasn't lifted after you finished the payoff, for a few months after? IRS is slow about that.

So be it. I would like to know why NVC even sent it on to the embassy if the I-864/I-134 didn't meet the requirements? I'm still paying the IRS. I filed 1040X for 2006 and 2007, now they owe me.

I guess the point is that this WILL be an issue.

It will NOT affect your petition. It COULD affect your visa approval at the consulate. Sort out your problems with the IRS and get a payment plan in place BEFORE they apply a tax lein. If this "letter" says they have already applied a a tax lein, then here is what will happen...the amount owed will be deducted from your annual income for calculating your affidavit of support, if this drops you below the guidelines your visa could be denied.

Do not go into this being crossways to the IRS, they are NOT good people to owe money to.

Good advice!

Not that I suggest this this...BUT you would be better off charging the money owed to the IRS on a credit card at 30% interest and then stiffing the credit card company. That would have NO effect on your visa process...ever. The IRs just has too many ways to collect on their debts and use all sorts of strong arm tactics not available to anyone else, they are the last people on earth you want to owe money to, they WILL collect or they WILL find a way to jam you up on something until you roll over and play by the rules. If Osama Bin Laden owed $6.34 in past due taxes we would have caught before Oct 1st, 2001.
