Hi: I have a devorce from the woman whom i got my 10 years green card. My question is if I remarry with her again after 2 and a half year and apply for the citizen ship am i eligible for the citizenship after 2 years or I have to wait for 5 years ?

im sure someone will correct me if i am wrong but if you have been here for 2 1/2

years then you have to wait 2 1/2 more years to apply for citizenship no matter if u marry or not.........

what is your"Resident since" date on your greencard?

It is my understanding that your path to Citizenship solely relates to the length of time you have had your green card. If you got your green card thru marriage you can apply for citizenship in 3 years from the time you got your green card. I assume you were married at the time of AOS where you got your "conditional" status removed?

It is my understanding that your path to Citizenship solely relates to the length of time you have had your green card. If you got your green card thru marriage you can apply for citizenship in 3 years from the time you got your green card. I assume you were married at the time of AOS where you got your "conditional" status removed?

but isnt that only if he has remained married to the same women and lived with her the complete three years? i thought that if there was a divorce or separation that he would have to wait until the five years was complete.

your marriage to a USC needs to be a continuous threes years, not 1 year here and 2 years there...

Are currently married to and living with a U.S. citizen;

and

Have been married to and living with that same U.S. citizen for the past 3 years;

and

Your spouse has been a U.S. citizen for the past 3 years.

i dont know if that is true or not but i think that someone while going thru the process of citizenship will ask u if it is true.......... if that was the reason for getting married to her again.

You should have done your research before you divorced her!

If you remarry your time starts all over since there was a lapse in the relationship. To avoid any problems I would wait the 5 years minus 90 days to file for citizenship.

03/02/10 Contacted Senator's office...No reply yet!

03/04/10 Senator office called says can take up to 120 days.

04/12/10 Service request filed.

05/12/10 Contacted Senator's office again.

05/12/10 Told over the phone that I was approved. Believe it when I see it!

06/04/10 Senators office tells me the adjudicator who interviewed me thinks I have a criminal record. Send out all paper work showing no criminal record.

06/08/10 Leave for Canada

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

Everyone's correct, your 3 yrs being married to your original wife that petition you is only matters for eligibility to apply citizenship through marriage. If you got another marriage with different person, so it didn't complied with the situation your trying to build up to. Your not eligible for 3 yrs bcos you're already divorce with your exwife now. You need to wait for the 5 yrs eligibility and it more wiser to do it. rather than complicating things at your ends. goodluck! :thumbs:

Hi MuhammadKhan,

Funny how you "co-incidently" got divorced and want to re-marry just 2 months after getting your 10 yr green card....Seems kind of like immigration fraud here.....(but then again, it might not be fraud, as I do not know the entire story here...who knows...just seems odd to me, that's all...)

Ok, fraud/non-fraud aside, in answer to your questions:

-Yes, as an LPR married to a USC, you can apply for naturalization after 3 years, instead of the standard 5, as long as they are "married to the same USC for all those 3 years, and that USC has to be a citizen for at least 3 years".

-However, in your case, since you are divorced, and not married to the same USC, you will have to apply for citizenship in the standard 5 years, instead of 3, regardless of current marital status. So just add 5 years minus 90 days from the 'residence since' date on their current green card, and thats the date onwards from when they can apply for citizenship.

I've no idea about remarry to the same lass, though.

Ya it would seem a little funny or fishy to get divorced after getting the 10 year green card, then remarrying so you can get expedited citizenship of 3 years instead of waiting 5. If I was an Immigration officer that is what I would be thinking. Now everything could be legitimate, but not to raise suspicion I would wait the 5 years.
