I think it's high time that we (by my count 11 of us) whose recalled petitions have been lost by either the UK, Russia, Thailand or Phillipines embassies start sharing information between ourselves in a new post, since there seems to be so little available. I for one have absolutely no idea where my k1 petition is. VSC don't got it, NVC don't got it, and the Embassy was supposed to send it like 2 months ago. My wedding party is 2 days away from postponed, as are my fiance plans to resume university in the fall. Luckily my fiance works for the US consulate and has been promised action on her behalf this week by someone-of-power at the Embassy to find out what happened to our petition. And I will post the findings here.

As far as the rest of you go, and I'm only talking about those of you like me who have NOT gotten their case re-opened, please share any and all information and thoughts you can. :help:

Cigarovich, I feel for you - that's so sad that you will most likely have to postpone your wedding; not exactly an option a couple likes to have to consider while wedding planning. :( Hopefully your ties to the embassy will help bring something useful to light. In our case, I have no idea where our petition went - other than the embassy in Bangkok sent it back on May 22nd. A friend of a relative of mine works at the NVC and he's looking into it. So far, he's at least been able to confirm that it's officially lost. That's progress...I think. I've stopped calling the VSC, NVC, and CIS because it's just not getting me anywhere and I end up upset every time I get off the phone - and I HATE crying at work! Plus they will only tell me I need to wait 120 days. Anway, I will post here whatever useful info comes my way.

dkm1432 has a petition in Thailand and his case was reopened on 6/22/2006. I wonder when his case was returned from the embassy in Thailand. Was it with the same batch? Check out the chart in the COMPILED

Hey, guys.

Not of my business, I know.. but I´d like to tell you what I think it´s good news.

It looks like Vermont is having a busy day. We already got another case reopened, 2 RFEs being sent, I got the RFE-received-back-update today...

I know you´ll only feel better once it happens to your case, but I just wanted to say I hope this is not a long thread. I hope you won´t ahve to post here because they will reopen your cases and believe me, everything changes when this happens.

Good luck. I´m looking forward to look at the chart and see your good dates there.

I am one of the MIAs and have been told different things by different agencies:

1- Called DOS in DC in mid June told by the lady that seems to say to all callers "Oh no" Oh no" "your Petition was recalled" and arrived back in that States on May 29th.

2- My Fiancee in the Philippines told me she just received a letter from the embassy (dated July 10th) explaining the IMBRA thing indicating the Petition was sent back on May 24th- so five days from Manila to NVC arriving there as the "Oh no Oh no" nice lady indicated sounds like the usual travel time.

3- I called VSC 2 times and was told the first time the recalled Petition arrived back there at VSC on June 22. The next day I called again and was put on hold, Karen came back on and said she called NVC and said NVC sent it to VSC on June 28th, and they needed to retrieve the file jacket (the part of the file that the adj officer documents the processing of the Petition-this is sent to the National Records Center in another state) before it could be re-opened.

4- Today, my congressman's immig specialist called NVC, and he said they told him they just sent the recalled Petition at NVC to VSC today (he thought that was a bit suspicious- the check is in the mail?). He also found out that what VSC had been telling me before was not that the recalled Petition had been returned there, but the file jacket from the National Records Center had already been returned there.

5- I recommend that you request your congressman or senator to file a formal inquiry with the Congressional Liaison for Immigration Ms. Sarah Taylor. She has a team of investigators that I have been told will get to the bottom of what is really going on. Be sure to fax a letter to your Congressman/Senator documenting what you have been through and list specific questions you want Ms. Taylor to answer. If your Congressman/ Senator's office tells you otherwise, tell them you know that other Petitioner's Congressman/Senators are doing this, so why can't they do it for you?

Thanks Rick for your comprehensive answer! I'm going to work my fiance's Embassy angle until I get an answer or not, then move to my Congressman's/Senator's office if I don't get satisfaction. I too have been told many different things by many different people - especially frustrating was that whole "it's not your recalled petition it's your file" thing from VSC.

I'm one of the Philippines recalled petitions (NOA1 March 13, NOA 2 March 29). Anyway, I do suggest anyone here call Vermont if you haven't yet and see if you get the same kind of answers. As a reminder, here's the process to get ahold of a person:

Hey Larry Thanks for sharing ur experience too. From what I can deduce from combining all the different stories from the different agencies and individuals, my recalled petition sat at the NVC for 7 weeks and I am just praying it finally got up and walked the hundred miles or so from Portsmouth, NH to St. Albans, VT. I would have gone up there and picked it up myself and crawled on my hands and knees through broken glass from Portsmouth to St. Albans. My congressman's immigration specialist has been great (last Tuesday he spent hours trying to get through to VSC). He told me about 3 weeks ago that DOS/NVC was angry at USCIS for approving the NOA1s post March 5 on the old I129, because there would be a deluge of reapproved Petitions coming back to NVC. It is interseting to note too, that Attorney Gary Bala has indicated USCIS indicated they usually had 6 months to adjust to new legislation. So in addition to the misssing 300 cases theory (another poster said a lady at VSC told her that), I am wondering if NVC has been dribbling them back slowly to ease the impending deluge? Anyway, everbody in this situation please share what you have learned, so maybe we can connect the dots. Rick

Just got off the phone with NVC (New Hampshire), spoke with Jane. They told me my case was recalled and they have it. They will be mailing it to USCIS today for further processing, hopefully it is going to the Vermont office. I don't know if this is because I contacted my congressman and they made an inquiry on my behalf. I wonder how long it takes to get from New Hampshire to Vermont?

Only ray of hope I have is my Congressmans office got confirmation from the NVC that my Petition was forwarded to the USCIS on June 28th. That's the last I have heard. The Vermont service center processing time page says April 3rd now, so Hopefully Im close.

I went expecting my Fiance to be here in mid September to now figuiring mid December after Manila gets done with taking there time all over agin. Another tidbit of good news is, Manila Finally made contact with my Fiance... It's only been 4 months :wacko:

I have lost all hope in anything going right from here on in on this. So I have decided to make another trip to Manila when the interview finally comes. I want to make Freakin' sure our Gov. doesnt screw me over again. I will leave nothing to chance anymore. Our Gov. can F@#$ UP A WET DREAM! I also want to find a Filipino or Asian specialist Immigration Lawyer cause I'm tired of being abused.

Anybody know a good Immigration Lawyer in the connecticut Area? The one I was using is Useless. The Guy actually was taking other phone calls while I sat in front of him in a consultation!!! Here he was stting in a suit and Tie with Birkenstocks on his feet, Scratching his Balls right in front of me!!!!! :unsure: Then He Hands me some Documents from Thailand from a previous case of his and tries to tell me that "Manila runs the same way... I have heard". No Confidence in him, Nor my Local or Federal Government.

Damn it!!! Now Im really Mad!!!! IM OUT OF SCOTCH!! :huh:

He also stressed that the formal inquiry sent to Ms. Sarah Taylor (Congressional Liaiason for Immigration) will not only result in her team investigating the specifics of my case, but she can speak with the Secretary about overall process problems and affect overall changes to a problemtaic system. SO, IT MAY BE BEHOOVING FOR ALL AFFECTED PETITIONERS, TO FAX A LETTER TO THEIR CONGRESSPERSON/SENATOR DETAILING THE SITUATION AND REQUESTING A FORMAL INQUIRY FOR YOUR CASE BY MS. TAYLOR. THE MORE PEOPLE THAT DO THIS, THE MORE PRESSURE WILL BE EXERTED TO AFFECT IMPROVMENT.

Well I finally got an email from the Embassy saying they sent it back to NVC in Portsmouth on May 25. NVC ignored my last email so I guess I'm going to call them on Monday.

It was about time, Cigarovich. At least now you have some kind of official document to refer to.
