Will visit fiance a second time in a couple weeks...should I wait to send K1 petition?

Hi, I finished the fiance K1 petition, and my fiance is from Argentina. I already met her once and am able to prove it.

I plan to meet her a second time in 4 weeks. I am wondering if I can show them more evidence of our relationship, the evidence from our second visit AFTER I send in the petition (so I can it in the UCIS building earlier, rather than later)?

Why not- You have met the requirement but the second visit will only give you more photos, passport stamps, plane tickets, and proof of an on-going relationship when you get to the interview.

Really whats 4 weeks when you look at the whole process- I don't know your whole case but wouldn't it be better then getting RFEs.

What I would suggest is to prepare your petition now, go back there with everything ready so she only has to put her signature and add her letter of intend.

Go home, add the evidences of the second meeting then send it.

No, you can't add anything once the petition is sent.

Sorry but the words you have written in brackets are unclear. Do you mean.... can you send further evidence of your relationship to USCIS AFTER you have filed the K1 petition?

No. Is the simple answer. Any information you submit to USCIS after you have sent your whole package in, will not be accepted as part of the petition unless you are asked by them to submit further evidence. The one trip you have already taken (and have evidenced in your petition) means you fulfill the requirement of having met (as long as it was within the last 2 years)

Any evidence of trips you make after you send in the petition can be taken to the interview and form part of the proof of your ongoing relationship with your fiance.

02/26/2010 - Passed my driving test :-p

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

personally we are getting the petition sent off now and are in the same situation as you (I will be going to america in a few weeks time), just to get a month off the timer!

Our biggest concern is the "proof we have met" due to lack of photographs (we only have 2), however have almost all the primary evidence pieces so assume we will be fine. In worst case scenario, if they say "We want more evidence you have met up", then well, I will be over in america at the time and it is much easier to deal with at that point (including the funny mental image of walking into the UCSIS together!).

If you've met once within the last two years, no need to wait for more evidence. Send that in. Use the proof of your second meeting at the intervioew as part of your proof of an ongoing relationship.

I firmly agree with the EARLIER posters, who recommended waiting and including the additional evidence from the second visit.

USCIS will not care about this extra evidence, but the embassy certainly might -- the extra evidence will add legitimacy to the relationship in the embassy's eyes. I highly recommend "front-loading" I-129F petitions with all possible relationship evidence when a Latin American embassy or consulate is involved, si man.

A short delay now could avert a 221(g) or outright refusal later.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you've met once within the last two years, no need to wait for more evidence. Send that in. Use the proof of your second meeting at the interview as part of your proof of an ongoing relationship.

I say do not wait. You will have the seond visit for the interview where proof of relationship is required. It is not required for the petition and will make no difference if you can show you have already met her

In our case, I visited the first time and then sent in the petition. I then went back again two and a half months later. That way, my then fiancee was able to bring additional updated evidence of relationship to her interview.

This is not correct. I sent in additional proof and it was accepted. OP I would submit my package now. Why should you wait? Alot of people only visited their fiance 1x and they received their visa.

02/23/09- NOA 1

02/24/09- Check cashed

02/27/09- NOA 1 Recieved hard copy in mail

07/04/09-NOA 2

08/08/09-NOA 2 Recieved hard copy in mail

09/15/09- Medical taken Sputum test required

9/22-9/24-Sputum Testing(Results negative) Now the wait begins for the culture results

11/24/09-Praise God Sputum culture negative......told to report to St Lukes for immunizations.

12/03/09- Medical Exam Passed and complete.

12/15/09- Interview Passed!!!! Visa Approved!! Praise be to God!!!

Good for this poster, but the advice may be perilous... and how can anyone say "it should be fine" with knowledge or authority? Do people really take the consular phase of the process so lightly -- or, worse, ignore or dismiss it completely?

Everyone here is focusing on what USCIS requires -- which the original poster can obviously meet -- yet the long-range view should include the possible reaction of the embassy. Multiple visits are always a PLUS in the eyes of consular officers -- and there is a world of difference between multiple visits versus just one visit in terms of strength of evidence.

As stated, a little considered restraint now can avert months of delay later. OP, hold off until you can front-load the I-129F petition with extra evidence of relationship from your upcoming trip. (You probably realize the sense in this already, or you wouldn't have posed your question in the first place, si man? :thumbs: )

In my case I had lived overseas for about 6 months and then went back to the u.s. and three months later went to see her and got engaged... went home and started the visa. I think it looked pretty good getting engaged and THEN sending it in. But in the end it really doesn't matter. If time is a prob send it in now, if not just wait and put as much info in the orginal as you can. A slim orginal will mean the VO WILL ask for more proof at the interview but a fat orginal might mean just questions (my case). No matter how you look at it there are + and - for each options, what you do will depend on what you need.

This is not correct. I sent in additional proof and it was accepted. OP I would submit my package now. Why should you wait? Alot of people only visited their fiance 1x and they received their visa.

YOU CAN NOT send extra info after the orginal has been sent in unless it is an rfe. I had to deal with that over an address and country change.... lol even if she moves from say the netherlands to ireland you can't change it untill it is approved and goes to nvc. I talked to 5+ uscis people, congress staff, and did my own research, sure maybe you somehow did add something to it, but 99.99999% of the time it isn't possible.
