I-601 from Jamaica!!!!!!!!

Hi Everyone,

Can someone please help me out here, I would greatly appreciate it.

Here's my story:

I came here almost 9 and a half years ago in someone else's passport from Jamaica. The problem is I have absolutely no evidence to proove this and no way of getting any. I guess I will be filing as EWI. I've been married for a year now and I have two kids that are not my husband's. Lawyers advised us that I have to go back to Jamaica for my interview after everything's been filed. Can someone help me get started with this lon process, what information to get to prepare to file the I-130. Has anyone ever filed a case like this without using a lawyer? I know we'll have to prepare a waiver packet but what's the first step,thanks.

The first step would be to leave the country and not come back. How dare you solicit advice from people who are patiently waiting and doing things legally.

If you have nothing to add to the OP's question, you are better off saying nothing. VJ admin has clearly stated that the kind of behavior you displayed is against the Terms of Service, so consider yourself reported. Who made you God?

To the OP: your chances are pretty slim; since you cannot adjust status as an EWI. You should consult a competent immigration attorney as soon as possible.

I agree with Len 100%. We're not here to judge and VJ was made to try to find answers to whatever questions we may have.

To the OP, I'm sure the lawyers you've already contacted for advice have told you that what you have done is illegal. Given your circumstances, I would advise you to not file without any legal representation as you may need it down the road. The process is not as easy for someone in your situation as it may seem.

I agree with Len, get a competent lawyer, this situation calls for good one and also find one your are comfortable. At least you're honest and that's a good start. Think positive. take care.

I suggest you depart as soon as you can. First you are going to have your USC husband file the I-130. After it is approved and an interview has been granted, you will likely be denied at the interview due to the overstay. Further, you will likely incur a 10 year ban (this is why leaving sooner than later is best since the ban begins when you leave). Once denied, you will submit the I-601 to try and get the ban removed. Once the I-601 is approved, you will be able to enter the US as a legal resident.

Are your children US citizens?

Agreed with one addition. You will also be found inadmissibale on grounds of misrepresentation which makes getting an I-601 approved a bit harder, but not impossible. It also carries a permanent (waivable) rather than 10 year bar. This is assuming the passport you originally entered with was not a US passport. If it was you have a whole other issue to contend with.

Lilly, I know your situation too well have friends caught up like that. You need a lawyer that's your best chance and that's still not 100%...sorry, but a so life go if you choose dat route...the passport thing not good at all and no baddah type dat now weh else...seen
