Wife traveled to the philippines with an expired green card help!

Hello,

Little stressed out right now and need some answers. My wife and I have have been married for over three years and have lived together here in Minnesota for a little over two years. She wanted to go home and visit the her family. She left on July 5th for a three week trip and was planning on returning home today. Well Unfortunately neither one of us realized that her green card had expired. They would not allow her to get back on the plane for her return flight, and is now stuck in the Philippines. I told her to go the U.S embassy and see what they can do but I have no idea what is going to happen.

I would appreciate any info on how to get her back home as soon as possible.

Are you saying she never removed conditions? [Filed a I-751?].

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

We never removed anything I thought since we were already married we did not have to do anything after her arrival. That she was permanent resident upon arrival. To be honest I don't really remember it been awhile since I had to deal with immigration. Hind is 20/20 we should of checked it but for now I just want to know how to get her home

Are you suggesting that with a good atty and a little luck, the USEM might print up a one-way visa to get Pinay back home?

One hope is if you guys were married more than 2 years when she arrived at her POE. If that was the case she should have received a 10 year GC and she would be OK with a bit of work.

Why do you have K3 in profile?

Hopefully it was a IR-1.

If not having failed to apply to remove conditions before the 2 year GC expired is reason for deportation and you guys are in deep dakine.

Time for a GOOD lawyer.

wow is all i can say my aunt is on the same boat if it was not 4 me she be on her way home next month b/c i saw her green card was expireing in 1month so i filled an i-90 for her. But in your case u have to call usics and talk to someone i have always goting alot of help from them. So call them as soon as u can and see what u can do for your wife.

02/06/2009-Noa1

04/27/2009-Noa2 Approved :)

05/02/2009-noa2 Hardcopy in the mail :)

05/18/09- Nvc case number and Ds-3032 also paid Aos bill

06/16/2009- paid IV bill

07/20/2009- sent out Aos ( yea I paid everything now im sending it. I was out of town with my hubby for 2months Thank God they let us pay online now only if we could send everything else online lol )

07/30/2009- Sent out DS-230

08/12/2009- Case Complete with NVC

09/01/2009- Visa interview has been scheduled for 10/05/2009. Letter by email.

That was not the case because when she entered USA they were married less than 2 years!

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

Dude, really? In the Welcome Notice she received when she became an LPR, and in the papers they give you along wit ht he visa; it clearly states you have to remove conditions on permanent residence.

Right now, you failed to comply with this part of the law; hence your only option remains to file another I-130 for an IR-1 visa.

i have a friend from church that the husband went home and realized that his GC is expired.... BUT HES HERE NOW!!!! please, before you apply and file another petition.... get an infopass first... i suppose they paid some kind of a processing fee im guessing 45,000 pesos to the immigration/embassy and he made it home... pls, before you do any move, consult immigration first....have your wife report to US embassy.... coz when i filed my i-90, there are options there if ever GC got expired abroad--- and there are things that you can do about it...

plssssss......if i were you i wouldnt file anything yet! have your wife go to US embassy first.......

------USCIS-- married since March 28, 2005 - I130 filed: july 27, 2007

NOA #1: Aug 6, 2007 NOA #2: Oct. 29, 2009 - APPROVED

--NVC--December 12, 2009 - Case# generated from NVC

December 17, 2009 - hubby received his letter from NVC[/font]

April 13, 2010 - received DS-3032 via email

April 19, 2010 - sent back DS-3032 to NVC thru DHL (did not email a copy)

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!

I was stuck in Russia last year! same case! But I have an appoinment in Immigration so I had Biometric appoinment. I went to US embassy and asked for a visa. Then they gave me and luckly I got my 10 yrs green card now. Tell her to go in US embassy in Manila then explain what happen...

according to your timeline she arrived in US(LAX) March 12, 2007. Did you guys married in US or in the Philippines? She come here with CR1 Visa? or K1 visa? If she intered here as a CR1 visa, she need to apply for removal of condition before her 2 yrs green card expired. Friend, you need to consult now an immigration lawyer here in US. then, She need ASAP to go to US embassy in Manila. It's 4 months expired?....let me know again what happen OK!

If her green card has expired and she did not remove her condition which i think she did not,, then you will be in big trouble for failure to remove her condition. Your only option is to ask the best immigration lawyer's help or file another petition for her (I-130).

I do hope there is a way she can come back here in the US. Keep us all posted.
