Well we were expecting them to request some signed 325's and letters of intent but they did not ask for these. Here is what they requested:

Apparently our 'passport style photos' were not correct so I am going to to to rite-aid or somewhere today to get some more passport photos and she is going to do the same.

I sent in some pages from the divorce papers i had from my past marriage, but apparently they were not what they are looking for. I am going to call the court and request 'a final (absolute) divorce degree' as all the papers from my divorce are back in NH and i am currently in FL so i will just request that these documents are faxed/mailed down here.

I sent in a copy of my birth certficate from the hospital where i was born, but that is not a civil document. I need one from a civil authority that shows birth in the US. It also lists i can use my passport, since i will not get it back can i just photocopy it? Do i need to photocopy all the pages in in, even if they are blank? Also they say i can submit a statement executed by a US consular officer certifying that i am a US citizen and the holder of a US passport, where do i find a consular officer?

Face size from 1" to 1 3/8"

Your photographs must be:

One (1) photograph is required for non-immigrant visas and two (2) photographs are required for immigrant visas and U.S. passport applications.

2x2 inches in size

Identical

Taken within the past 6 months, showing current appearance

Color or black and white

Full face, front view with a plain white or off-white background

Between 1 inch and 1 3/8 inches from the bottom of the chin to the top of the head

Taken in normal street attire

Uniforms should not be worn in photographs except religious attire that is worn daily.

Do not wear a hat or headgear that obscures the hair or hairline.

If you normally wear prescription glasses, a hearing device, wig or similar articles, they should be worn for your picture.

Dark glasses or nonprescription glasses with tinted lenses are not acceptable unless you need them for medical reasons. A medical certificate may be required.

Attaching the photo to your visa or passport application:

Staple or glue the photograph(s) to the form in the designated space. If the photograph(s) is stapled, staples should be placed as far away from the applicant's face as possible.

Do not enclose photographs in glassine or other types of envelopes. The photograph must be stapled or glued properly to the form in the designated space.

Yes - legibile copies are sufficient. If you copy your passport, include all pages (blank or not) front and back covers.

Your passport is sufficient to prove you are an USC (birth certificate serves same purpose).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Why can't you go to the registrar in the town you were born and get a BC?.

The statement from consular officer refers to children of USC born abroad.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

She went to a photo studio and spent 15 euro getting 2 photos, and they knew what they were for so her photos should be fine and i will also go get some done. I will also make photo copies of my entire passport every page front to back.... that should be enough, i think.... do i need to submit a BC as well?

I'm really sorry that they waited almost the full 6 months to give you an RFE. That's ridiculous.

yes waiting till 12 days till the 6 month mark to get an RFE is a little disappointing but that is the way it works sometimes. It is out of our hands though... I just called the court and they have a official divorce decree going in the mail today!!

If you normally wear prescription glasses, a hearing device, wig or similar articles, they should be worn for your picture.

The woman taking my passport style picture told me that a person CANNOT wear glasses in their passport picture. I hope this doesn't come back to bite me in the bum.

The US passport should be sufficient.

Does the RFE specifically ask for a birth certificate though? Or does it say (passport and/or birth certificate)?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She is wrong. You can wear them as long as there is no reflective glare on the lenses. Any glare that makes your eyes hard to see will be refused.

i was trying to look up what the cover letter for the RFE should look like, i didnt find much, when i read about people using COLOR photocopies of the passport front/back.... all the photocopies i have made were on the standard photocopier in B/W... would this be a problem? And does there need to be anything special in the cover letter i put with this RFE?
