I received the RFE today and mailed it back already. Its quite simple asking if I meet my spouse through an IMBRA and if I have commited any crinmes listed in the RFE.

If anyone can help me I do have one question concerning waiver request. Last year I submitted a k1 visa request and it was approved. But later I withdrew the petition because my fiance and I decided to get married in her country of residence. Now I am married and going the k3 route. I am not sure if a waiver request is required or applicable to k3 because we are already married and it seems to reference the k1 in the RFE I received.

I am applying for the K-3 and received the IMBRA RFE in the mail today. I guess they are sending it to all I-129F applicants.

ONE DAY AT A TIME....

REMOVAL OF CONDITIONS

12/30/2008: Overnighted I-751 package to VSC

01/06/2009: Check cashed

01/06/2009: NOA (arrived 01/09/09)

01/23/2009: Biometrics appt letter received

01/31/2009: Biometrics scheduled

05/20/2009: APPROVED

06/23/2009: 10 Year Green Card arrived

I got my RFE Email today too and it refers to itself as:

Application Type: I129F , PETITION FOR FIANCE(E)

I believe that is just a generic designation and you probably should'nt worry too much.

Although until the whole process is over, you can't help but worry.

Can anyone answer this question for me?

I received my RFE today for k-3 visa. In the RFE it mentions limitations on submitting K-1 visa petitions ( 2 or more k-1 visa submissions or 1 k-1 visa approved w/in the last 2 years).

I did have a k-1 visa petition approved but my fiance and I decided to marry in her country of residence. So I withdrew my fiance petition and now we are married and filing a petition for k-3 visa.

Am i required to submit a waiver?

Do these limitations affect the k-3 visa?

Im thinking how can this possible apply to k-3 due to the fact I am already married??

Did anyone else notice the department of homeland security AKA: USCIS is in desperate need of organizational and supervisory help.

They have finally managed to implement a law that has been in effect for 3 months now!

They managed to develope a form comprised of 2 questions in a 5 month period (3 months late) after the IMBRA Law was passed in Jan 2006 AND in effect in March.

Im not venting but its BS!!!!!

but anyways... if anyone can offer advice on the waiver that i may be required to submit or not?

According to the I-129F instructions 'No' as it has only K-1 when referencing 'filing limitations' and 'waivers'. Spouse is only mentioned in the section under 'Mandatory Tracking'.

Can someone please tell me what IMBRA stands for>?? I hope I am not missing out on something important?? I just got my RFE in today also.. but my I-130 was apporved last week so not sure what to do about it all!!

I would continue with your I-130 as normal.

also I would mail the RFE back like it states in the letter and continue with th3 k-3 as normal.

just wait and see which is faster.. your looking good seems your case is making good progress.

you have nothing to worry about.
