hi All,

i want to ask for help. my fiance is a half thai and half filipino. he was born in Thailand and months after they migrated to USA. my question is... his birth certificate and baptismal is in Thai and the documents are not original. is there any way he can request for an original copy of his birth certificate and baptismal coz he wanted to have it translated in English but according to the translator they won't translate documents unless it is original. Is there any way we can request for original documents thru internet or by calling or whatever rather than flying to Thailand? please help. :help:

I believe that a certified copy can only be obtained in person at the Amphur (district) office of where he was born. Perhaps he can sign over power of attorney to an immediate relative, thus avoiding the travel. I would be contacting that immediate relative to find out. If he has none in Thailand, will probably have to go back.

My wife, her mother, her father, and Phu Yai Ban (village headman) went to the Amphur together. In my wifes case, she does not have a birth certificate, so she got an official paper from the Amphur stating that no birth record exists, and this was good enough in our case.

I have seen other people from Thailand have a real hard time with this Thai birth certificate thing. It seems like DOS has one standard of what they will accept, and USCIS has a much tougher standard. I have seen multiple people get approved at the embassy, and then when filing AOS they run into all kinds of issues, RFE etc. due to this Birth Certificate thing.

I would say do everything in your power to get an original/certified copy of the original with the Amphur stamp etc. Then get that translated.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
