Timeline

Ok, here's the situation:

I filed for AOS, EAD and AP when living in Illinois and moved to NJ a couple of months later. Did the AR-11 and change of address for the on-going AOS, EAD and AP online, and successfully received verification letters for the address change to my new address. I've received biometrics appointment notice and AP-approval notice to my new address.

On May 20th I get a CRIS-email saying that "the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable". I called the infoline as suggested and told them my new address again. They were of course unable to tell me which address the notice had been sent to.

Should I take any further action or just hope that USCIS/post office will get it right next time?

A friend of ours had the same issue - almost word for word - their EAD, and a week later the GC, arrived at the new address (with the previously 'undeliverable' envelope attached inside). (In other words - it was undeliverable, returned to USCIS then immediately sent back out to the correct address.)

Kind of a head scratcher but it was there nonetheless...

Today I received the notice that they sent to the wrong (old) address. It is a biometrics appointment notice that tells me to be in Indianapolis on June 1st! I also got a letter explaining that: "Our systems indicate that your I-765 Application for Employment Authorization was approved on May 5, 2009; however biometrics are required in order to complete the Employment Authorization Card". I've already been to a biometrics appointment in NJ (new address), but as I compare the two notices I notice that on the one I went to it only says case type I-485 and on the one for Indianapolis it says case type I-485 and I-765. I was of the impression that the biometrics that I did was for both I-485 and I-765 since it says code 3 and I did all my fingers, but I'm now guessing that I actually haven't done the biometrics for I-765?

So what to do now? I will not be able to go to Indianapolis on June 1st. I'm planning to send back the appointment notice with the reschedule check-box checked and attach copies of the biometrics appointment I did go to as well as the recipt for my earlier address change and an explanation of what's been happening so far. Would it be wise to also schedule an infopass? In that case, how do you go about doing that? Should I send the same info to the office in NJ as well since I'm guessing that they might want me to come back there for the biometrics for I-765?

Did your sponsor spouse also send in the I-865 Address Change Notice? THAT one will actually update your mailing address on any on-going applications, whereas the AR-11 does not, unless you follow up with it.

Your sponsor is also required by law to notify them of any moves as well, for 10 years, or until you get citizenship.

Yes, my sponsor sent in the I-865. And I did both the AR-11 and change of address for the on-going applications. Didn't seem to help unfortunately.

Maybe you haven't read my previously posted threads but

It is completely very bad idea to change your address during AOS process.

You have caused a big confusion for USCIS which is not perfect governmental office.

Even they have changed your address partially, it will take them so much time to update your address completely & forget your old address. You haven't seen the bad situation yet, some people's GC were mailed to their old address & were lost, and guess what they had to wait about 8 months to get the GC plus they had to pay $370 for I-90 application. I know it is very frustrating. Hopefully it won't happen to you,

We knew it was risky to move in the middle of the process, but we didn't see any viable options. At the point we are at now it's also pretty pointless to regret what has already happened, we have to find the best way forward.

You had better make address change through your local PO in Illinois,

so they can forward the 1st Class Mail to NJ. Unfortunately, there is not much communication among USCIS offices, that is why some offices update your address, others don't. There is not much you can do about it, from now on everything depends on your luck.

pfffffffft, that's nuthin! I've seen people in here over the years who were put into deportation proceedings because USCIS mailed their AOS interview letter to the wrong address and they never showed up for it (obviously).

Strangely though, UCSIC managed to find them to mail them the deportation notice letter :wacko:

To the OP, make an INFOPASS appointment, show them copies of the address change forms that you had previously sent in, and the receipts you got back from them. They should be able to sort it out and get your appointments set for your new district office, rather than the old one.

Does it matter which reason I pick for scheduling the infopass? None of them applies to my case since it hasn't been 90 days since I filed for I-765 yet. Will I be assigned a time for the infopass or do you have any possibility to choose from available times (will leave the state for a week beginning tomorrow)?

To the OP, make an INFOPASS appointment, show them copies of the address change forms that you had previously sent in, and the receipts you got back from them. They should be able to sort it out and get your appointments set for your new district office, rather than the old one.

Timeline

Update: After mailing USCIS explaining that I was not able to go to Indianapolis for the biometrics appointment and enclosing proof of address change and the biometrics that I had already done in New Jersey (for AOS) I got rescheduled for the biometrics for EAD. Fortunately this time in NJ! So on Saturday I'll head for my second biometrics appointment, and hopefully everything will be on track again. So I'll put the infopass on hold for now.
