Hello everyone, i have a question that i hope someone can help me with. My mother is a permanent resident and she did the i130 petition for me, it has been approved but i am waiting for a visa #.I was able to received the i94 and a ssn and a work authorization because i was under 21 years of age my i94 expired in 2004 but i am still in the us and i am getting married very soon to a us citizen, does any one have a idea of what paper work i need to fill out and how long i should take. Thank you

You will be adjusting status based on marriage to a US citizen NOT a K-3 visa. You will be abandining the current I-130 that is at NVC and your US Citizen spouse will be filing a new I-130.

DO i need to leave the country since my i94 has expired and i am no longer legal in the U.S

DO i need to leave the country since my i94 has expired and i am no longer legal in the U.S

NO :no:

Do NOT leave the USA, doing so even with an AP document. The POE can prevent you from re-entering the USA even with an AP doc, so save yourself and dont bother fileing I-131 with the AOS package.

If you leave the USA you will be doing a spousal visa and WILL need to file for a waiver of the overstay bar.

on my i94 it says its a V2 Visa
You are lawfully in the USA waiting for your visa origional visa.

What Is a V Visa?

just to make sure i understand my fiance should petition for me by doing the i130 now or after we get married? then i should petition for a i129 or what do you suggest, keep in mind that my v visa expired in 2004 i read somewhere that if i applied to adjust my status here it would be illegal.I also read that after i had turned 21 with the v2 visa i had to leave the US but i am still in the united states and i am 26.
