I-751 filed. No NOA yet. GC expires next weekend. Will I be able to work?

Hi VJers.

I filed my I-751 with the CSC last week, but my conditional Green Card is set to expire a week on Saturday (i.e., 05/16/09).

If I do not receive my NOA1/extension letter by then, will I still be legal enough to keep working after my GC expiry date until the extension letter arrives?

Has anyone been in this situation before?

(Note: My petition was delivered and signed for at the CSC, and my check has not yet been cashed. I don't anticipate any problems with the CSC accepting my petition - everything has been signed and dated: the I-751, I-751 attachments, the check [made payable to US Department of Homeland Security for $545])

I-751 - Removal of Conditions

05-01-2009 - I-751 Packet Mailed to CSC via USPS Express Mail

05-02-2009 - USPS tried to deliver. Nobody home@CSC. PS Form 3849 left for CSC to reschedule delivery.

05-04-2009 - I-751 Delivered to CSC@6:28am. Signed for by "V SEMEGI".

05-04-2009 - NOA1 Receipt Date. Same day as delivery - Wow!

05-14-2009 - Check cashed

05-16-2009 - Conditional Green Card expires

05-18-2009 - NOA1 Arrives in the mail

06-22-2009 - Biometrics notice arrives in the mail

07-06-2009 - Biometrics appointment @ 1pm

07-06-2009 - Biometrics done

07-06-2009 - Touched

07-07-2009 - Touched again

07-20-2009 - APPROVED! - Official decision date (Day 81)

07-22-2009 - Card production email received

07-24-2009 - Approval notice received in the mail

I would suggest you to make an info pas appointment. When you apply that close to your GC expiration date. Always use money order and faster delivery like USPS express mail which you did. I guess you sent personal check which can take 1-2 weeks or more to clear up. You should have sent money order for faster NOA, or applied at least a month before your GC expiration if you were going to send personal check.

None the less, Make an infopass appointment show proof of your mail I-751 delivery and hopefully your check will be cleared before 05-16 ( your GC expiration date), if it does take a print out of your online statement which shows image of cleared check (if you have that option) and take both the print out of cleared check and delivery confirmation from USPS to your infopass and request them to give you I-551 stamp on your passport (which is equilvalent to NOA or a temporary green card).

Tell them you didn't get NOA and you need I-551 really bad as your GC expired and you need an offically document or stamp to proof your legal status ( normally the IO (Immigration Officer) do give you Stamp if you didn't get NOA, but if they don't seem to be convinced at first, try harder politely and if it doesn't work out ask for their supervisor etc, which i am sure wont happen to you ).

If you don't have NOA or I-551 you don't have proof that you are legal to work and stay in the US. Please do it ASAP.

It is your card that will expire not your status. unless you are planning a trip outside the US you do not need a I-551 stamp. If you employer wants to renew your I-9 you only need a unrestricted SSN and a state ID. Thay can not demand to see a greencard.

There is no evidence to say that paying by money order is any faster than paying by personal check. The problem has arisen because the OP filed so close to the expiry date of the card.

April 15th 2009: Package received at CSC

April 27th 2009: Check Cashed

May 15th 2009: Received Biometrics Notice

May 18th 2009: NOA1 finally showed up

May 30th 2009: Biometrics Appointment

June 13th 2009: Received RFE

June 16th 2009: Sent RFE to CSC

June 17th 2009: CSC Received RFE

July 15th 2009: CRIS email : card production ordered

July 20th 2009: CRIS email : approval notice sent

July 23rd 2009: Received 10 Year Green Card!

It depends on what the rules are in the state of Nevada (or wherever it is that you reside).

When I need to get a KS drivers license a few months ago, I did have to show my Green Card, even though the guy at the Drivers Licnese Bureau didn't look too closely at it.

I see from your signature that your check was recently cashed by the CSC. Your NOA1/extension letter shouldn't be too far away!

Hi, not sure about your state. California-DMV (Sacramento) sent me a letter 2 months before my driver's license expires and gave me lists of things to submit. And of course I submitted what they requested, especially the NOA1 from USCIS (stating the one-year extension, etc...), and I received my new driver's license April 21 (about 2 weeks from the time I sent them the requirements).

My GC expired on May 28, 2017. I sent my I-751 packet on May 27. It was delivered to Vermont Service Center May 30. I paid my fee via USPS Money Order. My Driver's Licence did also expired and I am just waiting for a NoA to arrive so I can renew my DL. I don't work so there's not really a problem. But reading through all these thread of topics, may I know what is this INFOPASS y'all talking about? Thank you in advance.

 

i am starting to stress out here because I might be asked to re-apply for Adj. of status. because of few days late. I really believed that USCIS will consider the filing date based on date stamped on the packet.

Basically it is an appointment you can schedule with your local USCIS office to discuss whatever issue you might have. They're often more helpful/useful than the USCIS help line.
