Hello everyone,

I posted this question before, but felt i should explain my situation more to get helpful responses.

My boyfriend and I started a Long distance relationship in October 2008. (we have known each other for 6 years prior to this).

January 30th we decided to live together in the USA (his home). I have been "visiting" him here in the USA since.

However, I have been back to Canada 3 times (feb and March). It is now May and we are engaged. We want to get married.

We really need some good advice please.

What is the best way to go about this. BOTH - financially and legally.

Get married and then apply for whatever is needed for me to be legally in the USA? Or get a k1 Visa (which i really dont want to do because of having to spend time apart).

If anyone can give me some advice on this matter it would be much appreciated.

2/7/13 mailed I130 x 2

2/14/13 checks cashed $420 x 2

4/3/13 RFE more divorce info requested and marriage certificate(which I had already sent)

4/9/13 mailed additional info

4/19/13 I130 approved

5/10/13 NVC received

5/16/13 Called NVC and got Case #s and Invoice ID #s

5/17/13 USCIS website states: Your case can not be found at this time in My Case Status. Please check your receipt number and try again.

5/24/13 Paid AOS ($88.00) fee online

5/30/13 Emailed I-864 package for both kids

6/3/13 paid IV bill $230 x 2 kids

6/5/13 IV bill shows paid, DS260 available

6/14/13 CHILDREN'S PASSPORTS ARRIVED!!!!

6/14/13 filed online DS-260 for both kids

6/16/13 emailed Supporting docs for DS-260 for both kids

7/9/13 CHECKLIST for both kids...sad.png

7/9/13 checklist response sent (birth certs and passport Bio Page <again>)

8/2/13 CHECKLIST both kids

8/3/13 checklist response sent (I-864 AGAIN and paystubs - sent last 6 paystubs)

8/28/13 ***** INTERVIEW SCHEDULED***** for 10/9/13

9/11/13 Medicals completed in Toronto @ Dr. Seiden's office

10/9/13 INTERVIEW APPROVED

10/25/13. SSN cards arrived

Don't know what 'trailmix' said, as it has apparently been edited out, but you have multiple options:

- If you should happen to come visit with no intent of staying permanently, then later decide marry and petition to the USCIS for "Adustment of Status" (AOS) to permanent residency, that would be perfectly legal. Note the "intent" bit, as it is critical ;)

- Alternately, if you want to marry in the USA later, then the USC can file an I-129F for a K-1 "fiance(e)" visa, which will take.. on average... 6 .. 8 months (maybe less, maybe more) like many of us here (see the K-1 forum and guides).

- Alternately2, you might decide to marry there in Canada, then the USC would file an I-130 (and an I-129F, not sure?) petition to bring his/her wife to the USA under either a K-3 or CR-1 (I believe it is) visa (don't know much about this, I'm afraid!) ...

- Alternately3, if you both decide to reside in Canada for an appropriate time (6 months?), the USC could do a direct consulate filing to bring the alien spouse to the USA (I-130 and maybe I-129F? not really sure) which seems to be the fastest approach possible for those that qualify .. as I have heard... (?).

Read the Instructions / Guides on this site for more info. Each case is unique. I don't know and wouldn't even try to guess what is the best for you :)

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)
