I-864 Packet - What evidence should I include?

Timeline

My USC husband is a physician, and is employed by his own holding company. So his paychecks are cut by himself, and his employer is himself. I am wondering what to submit with the 864 as evidence in addition to tax returns. A letter from his employer or his paychecks aren't very convincing. He has federal tax returns that show well over the poverty limit, so I'm wondering if I should just send those in instead.

Also, I am wondering if the I864 also requires supporting documentation like a copy of my passport or birthcertificate. I will be sending those docs in with the concurrently filed I-485, but I am wondering if the 864 packet should have its own copies.

Any help is much appreciated!

I am confused, you posted this to adjustment of status, yet your profile shows CR-1/IR-1 visa filed for.

I-864 only REQUIRES copy of past years (2008) IRS return. A return is 1040 + Supporting evidence, in the case of self employed I believe Schedule c needs to be included.

Each form needs to be able to stand alone, so attach a copy of passport or birth cert to each.

I-864 only REQUIRES copy of past years (2008) IRS return. A return is 1040 + Supporting evidence, in the case of self employed I believe Schedule c needs to be included.

Each form needs to be able to stand alone, so attach a copy of passport or birth cert to each.

I am confused too- that's how I ended up posting in the wrong place! Sorry.

He's technically not self-employed- he works for a corporation, but he is the sole shareholder of that corporation. All his income he takes as on a W2, so we used the EZ form.

Either/or on the passport and birth certificate, or include both?

I had originally filed for a CR1 visa, but I am adjusting status from my visitor visa instead.

Does the I-864 need its own copy of the passport or birth cert? (I thought it was a supporting document for I-485?)

Also, do we have to send a $70 check for the 864? (USCIS website says the Dept of State "charges a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad.").. I am in the US filing for an AOS from B2.

Note: you WILL be interviewed by USCIS, and more than likely they will have many questions about your intent upon entry to the USA when they see the I-130 that was filed for an IMMIGRANT visa, you clearly show Immigrant intent when you used a visitor's visa to enter the USA, use of a visitor's visa to immigrate is visa fraud. USCIS can deny adjustment and deport for this.

You are playing a dangerous game with immigrations law.

No fee for I-864, this is part of the $1010 paid to process I-485.
