My husband and I have been married for almost 2 weeks now (yay :D ) after his entering the US on April 11th on a K1. So we waited for awhile to file for his SSN just to make sure he is in all the systems. But as I dig through the SSN instructions/guidance, I'm seeing that the K1 is authorizes the alien to work. If so, what is the necessity of the EAD? Not that I'm trying to avoid filling out another form, but I'm just trying to understand. Thanks!

When he gets his SSN it will have a notation on it saying it is valid for work along with Employment authorization. so he will need the EAD to show he is authorized. Once he has a greencard he can get the notation removed from his SSN card.

This is NOT a question about filing an I-129F for a K-1 visa. Moving this to WORK/Travel prior to green-card forum.

K-1 is NOT a work visa, K-1 is for entry to the USA for marriage to the person who files the I-129F. USCIS has told SSA to issue K-1 holders the SSN so that they can then apply for a marriage license, some states will not issue a marriage license to persons who do not have SSN. SSA will issue a SSN that has "With DHS auth" notation on it this tells employers to request work authorization evidence (EAD or Green-card).

Having a SSN is NOT work authorization, SSA does not give this permission, USCIS does.

In looking over the SSN Guide, I've found the following under the "For K1 Holders" section:

Your card, when you receive it, will be marked with the words "VALID FOR WORK ONLY WITH INS AUTHORIZATION"
indicating to an employer that you must also have an unexpired
EAD
to be eligible to work.

Unfortunately, I think there was some miscommunication here - EAD is required before one can work.

K-1 does NOT authorize work. The forms (I-9) for employment eligibility changed in February and began enforcement in April. A K-1 is not eligible to work until they have EAD or GC. File both at the same time (no extra charge) and you may get the EAD a little sooner.
