Hi guys:

I just want to give you and update about my case, today they took my fingerprints and everything was OK. But when I gave my letter to the person that take the fingerprints, she asked me if i have been fingerprint there before and i said yes, so she asked me for the letter and when she looked at them she was mad (not with me), she told me that some offices have been sending wrong code on the letters in my first letter a had code # 2 and in this letter i had code #1; and she told me they supposed to sent me code # 3, instead of send me two letters with code # 1 and code # 2. I know it is confusing, so then she explained me this:

CODE # 1 = 10 FINGERS BIOMETRICS

CODE # 2 = RIGHT INDEX FINGERPRINT AND PICTURE

CODE # 3 = ALL OF THE ABOVE

I did not know that, so i never pay attention to the codes i thought they knew it what they were sending. She also told me that they are being doing this mistake lately and it has to stop, they took copies of my notices and gave them to a officer that is gonna contact the office and bring this to their attention. That is making them to loose their time and my time (just for a simple number).

anyway guys, I let you know if they send me my green card soon. I'm praying everything will be all right this time.

06/17/11 Paid IV fee.

06/22/11 IV Showed Paid.

06/23/11 Sent DS-230 via Express Mail.

06/24/11 DS 230 was delivered by USPS.

06/28/11 AOS was accepted per AVR.

06/30/11 Received AOS check list. Missing DS-230. (It was sent 06/23/11)

07/07/11 Case Complete per AVR and operator. Waiting for interview date.

08/01/11 Per NVC Operator Interview date 09/28/11

09/26/11 Medical test. Passed!!!!

09/28/11 Interview date @ BGT embassy. Approved!!!!!!!

10/06/11 Visa arrived.

10/19/11 Arrived to USA. POE ORLANDO

Holly Molly! Maryces, that's why it costed you the mistaken denial before. They really need to get their act together. :bonk:

Although I know the difference before and I know all three steps that I took/taking/will take with USCIS has to be all code 3, but now I don't really remember what exactly does my biometrics letter said. I better look at it again when I get home.

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

i filed at VSC in 05/2008, had the biometrics done 8/20, then got a letter on 3/23/2009 saying my fingerprint card had expired, and when had to go to a support center to get the taken again on 4/03/09. The technician said they had the wrong code... so now am still waiting to hear from VSC

I totally understand. There is a recent post about 18 months approval on waiver case. Really don't know what to believe anymore. Maryces, your case should be put at extreme priority because of all these pain they've costed you.

So did the nice lady took your picture and right index fingerprint anyways? If she didn't, they might have to ask you to go back again.

Once again, what is wrong with these people? There is no reasonable reason for you to be treated this bad, even if we are immigrants, this is no civil war era anymore.

Huh?! :blink: She knows it's wrong and she still only did the code 1?! I guess she can only follow order. Well... sorry to say, you have to call the mis-information line again to make sure there won't be any trouble. Not sure how are they doing to make your GC without the picture. Just from experience, code 3 was used for the AOS and conditional green card, code 2 is used for your ten year card where your photo and right index finger is on it, and code 1 was used for the N-400 as then, you have to supply your own passport type photos that are used directly on your USC certificate. Three separate long trips just for biometrics.

I had Code 3 for AOS and is expecting the same for my ROC, and it will be more than a year since I last had my photo taken (if my calculations are correct) and am not expecting to receive my ROC biometrics appointment before it "expires";

To explain why such code is important in I-751, below is from the USCIS bulletin update dated Feb 2007,

"U.S. Citizenship and Immigration Services (USCIS) announces the implementation of a new nationwide

biometrics process for conditional permanent residents who file Form I-751, Petition to Remove Conditions

on Residence. The new process is effective immediately.The new process, as authorized in 71 Federal Register 15469 (March 28, 2006), requires all conditional permanent residents to appear at a USCIS Application Support Center (ASC) after filing Form I-751 in order to have their biometrics electronically captured.

An ASC appointment notice will automatically be sent by mail to the applicant with the specific date, time and location for biometric processing. Biometric processing includes the electronic capture of an applicant’s photograph, signature, index fingerprint and ten-print fingerprints. The photograph, signature and index fingerprint are used to generate the lawful permanent resident card, if the Form I-751 is approved. The ten-print fingerprints are captured for the purpose of conducting a criminal background check and are processed for applicants between the ages of 14 and 79.

Applicants (except for “overseas applicants” described below) will no longer be required to submit passportstyle

photographs, since photographs will be captured at an ASC."

As to what the USCIS do back in the old days for I-751 processing,

"Under the old process, following the approval of Form I-751, an approval notice was issued instructing the applicant to appear at a USCIS District Office for processing of his or her Form I-551, Permanent Resident Card (“Green Card”). The approved applicant would manually submit passport-style photographs, index fingerprints, and a signature on Form I-89, I-551 or I-586 Card Data Collection Form, for creation of his or her permanent resident card."

Knowing what to expect and understanding the process would, IMHO, definitely help to ensure that these USCIS folks are rendering the proper service, one cannot rely on their so called "competence" and training alone.
