Stephen just called me (6:45am - March 23rd 09) and told me his visa was DENIED? He said they told him our relationship WASN'T bonified, can you imagine! He said the interviewer had the nerve to ask him WHY DIDN'T HE EVER GET MARRIED (because he's 50) before, Stephen replied "because he never met his SOUL MATE until now (meeting me)." He said the interviewer told him that he feel Stephen TOOK ADVANTAGE OF ME (LIKE I DON'T HAVE A FREAKING MIND OF MY OWN TO MAKE MY OWN DECISION).

OK, enough of me ranting ... If I ever needed Vjers, it's NOW, WHAT DO I DO NOW? Do I contact my Congressman (they just opened an office in my town)?

Oh gosh, I am so sorry. What evidence did you present for a bona fide relationship? Get heaps more and look into filing an appeal. Contacting your congressman will be a good place to start.

You do have the option of getting married then filing again. But that requires compling lots more evidence of a bona fide relationship.

A non-bonafide ruling is a subjective ruling if nothing substantial can be found the VO becomes a sootsayer and will issue this ruling. The non-bonafide was meant to be use for sham marriages, in which substantial facts were discovered that the marriage was for immigration benefits only a "sham marriage" but now it is being used as a catch all.

You have limited time to get into action. Once the file gets returned to the USA your chances are slim of getting a visa based on this petition. Move quickly.

According to Stephen, the officer asked him "why didn't WE get married when I visited Nigeria the second time." I TOLD STEPHEN FROM THE BEGINNING, the reason we weren't getting married in Nigeria was due to the ADVISE of my Attorney (to do a K-1 vs a K-3), my Attorney said her opinion was, it would show that we WERE bonafide by getting married in the U.S. with ALL my FRIENDS & FAMILY (ALL 350 of them). NONE of my family members would've travelled to Nigeria anyway, and the ones who are financially able to travel said they wasn't going to be in the air for 12 hours and just wasn't interested in travelling to Nigeria but they did assure me that they would attend my wedding here in the U.S.

Life!

Have you worked with Senator Warner's office? I have been dealing with Webb's office on the whole USCIS mess and am not too satisfied...

I just had an interview for a K1 and I thought they asked some very rude questions. The evidence that helped us was flight information and photos. I hope you take action and things go well. I would demand another review. They also asked why we did not marry in Nicaragua...isn't this a personal decision. The women also asked my Fiance 'Why didn't he fall in love with a girl from his hometown....This really upset me. She rolled her eyes and everything. I am writing a letter once I am back in the states. I know they need to ask questions that are personal but to bring their personal opinion to the questioning is out of line. Good Luck!!

I am sorry to hear this my sister. You need to appeal this decision. Age is just a number and as long as you have the facts to back up your relationship, age should not be a factor. GOOd LUCK.
