WE ARE ON STAGE OF RFE..... THEN WE WANT TO CANCEL.....

HOW? DO WE RESPONSE THE RFE DOCS THAT SENT BY THE USCIS THEN WE ENCLOSED OUR FORMAL LETTER

WHAT IF WE IGNORE THE RFE? DOES IT MEAN IT WILL AUTOMATICALLY EXPIRED AND HOW LONG?

COZ BF STILL IN THE HOSPITAL HE CANT MAKE IT COZ ITS COMPLICATED FOR HIS SITUATION...

WHAT ARE THOSE COMMONLY DOCS THEY WILL ASK " RFE"

ME AND BF NOT MEET IN REAL....... COZ HIS VERY SICK MAN AND IT WONT ALLOW HIM TO TRAVEL

I am confused. You filed and received a RFE? You have not met your fiance? (You should read on the instructions about filing fraudulent information. You could already be in big trouble.)

You just answered your own question ... they want evidence that you have met within the last 2 years, and not a day over .... There are only extreme cases were they will accept a petition when the 2 people have not met ... religion being the biggy, health reasons were one of the couple is unable to travel and the other has been denied a tourist visa ... even then its difficult ... why did your fiance file when you hadnt met previously, thats a lot of money to blow when you obviously didnt meet the requirements ...

Most likely the RFE is for proof of having met or proof that for the very specific reasons why you have not met in person. In your case it sounds like that would be the medical proof that he is unable to travel for medical reason, by proof I mean letters from his doctor, and ALSO proof as to why you could not come to meet him.

Approval without having met in person is almost impossible to overcome and almost always will be denied. As to cancelling the petition I am not sure as you mean canceling it for now and re-filing later or ending the relationship.

To cancel the petition the petitioner must write to the office that has the case and request this.

No wonder you have a RFE. One of the requirements is that the two of you have met and you have to furnish proof of your meeting. You do not have any proof.

Who May File This Form I-129F.

2. You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

A. The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice; or

B. It is established that the requirement to personally meet your fiancé(e) would result in extreme hardship to you.

Unless you fall under B and can prove it with your submission, then you should not have filed in the first place.

You may want to get an immigration attorney for their answer. From what I see, you should not have filed unless you submitted all the proper evidence.

well he said to me that he did enclosed letter from the doctor, and the reason why he cannot travel.....

he just filed coz he still thinking for a positive or miracle that it may happen that the petition will be approved...... i know what u mean it wil be impossible that having a approval.... coz we havent meet in real person..... as of now his in the hospital...... he havent know yet what rfe ... and what docs they gonna ask ... and for sure he cant give to them coz his really sick... still having his chemo......

if he couldnt make to submit those docs they ask, what gonna happen??????? does it automatically end?

a lot of my friends told it will deny... coz we havent meet in person...

to be honest i dont know what to do......

imagine.... he filed JULY and just march pop up that RFE... its about 8 months......

within that 8 months thats the time he also starting his chemo til now and we dont have communication by phone....

They're going to need the proof that you and your fiancee have actually met at least once before you filed the petition....if not the petition will be denied, so no need to cancel.

That it took 8 months for USCIS to issue the RFE is besides the point. You two have not met....therefore there is not basis for the I-129F, the end result is denial of the petition.

When your dealing with immigration there are no miracles ... they want cold hard facts and evidence that you are a couple and that you meet all the minimum requirement for filing .... At this stage if you want to continue your fiance will need to get letters from his doctors stating that he is incapable of travelling due to his illness and chemo that he needs for treating his illness .... and you will need to find out what you need to provide as evidence of hardship which is holding you back from visiting your fiance ...

If there is no response to the RFE by the date given the petition will be considered abandoned. Good luck but personally I don't understand why he filed knowing it would be denied.
