I was wondering if anyone knows what my fiance has to do to get a drivers license in Calif ? We are getting married Monday. She arrived on Dec. 23rd. We just came from the DMV and were turned down. She already has a SS#. I have looked through the DMV web site and there is nothing noted about validity along with the I94, the guy said she had to have approved Adjustment of Status before she can get a drivers license ?

Thanks for any advice.

her I-94 is about to expire that's why you were turned down. wait til she gets her EAD then go back to DMV and show that as a proof of legal presence however you might have to wait for over a month til she gets her license because they still need to verify that document. i originally applied for ID last Nov and they accepted my application but they put it on hold because my 1-94 is valid for 90 days only. I went to DMV again when I got my EAD card.....that was last Jan. 28 and until now I still don't have my ID. I went the other day to follow up the status and they told me that it's pending due to verification of my legal presence but they gave me the # of the legal presence verification department in sacramento so yesterday I have been bugging them about my id but unfortunately they couldn't read the document that I faxed them so I have to call them again next week.

The license would only be valid for as long as the I-94. It is the same if, after you do AOS, it would only be valid for as long as the USCIS document such as the EAD or green card.

By the way, does she know how to drive? I got Claudeth driving lessons and try to let her practice with the truck as often as possible and have a feeling she might be riding a bus for the rest of her life :P

Yep. The key is getting an EAD first to get your California ID card. Once she has her EAD, she can also take her written test, and once she passes that, she can get her learners permit. My wife is just about expired on her learners permit and not ready to take the driving test yet. Soon maybe. We went out a couple times yesterday for her to practice. Be patient, if she has never driven before.

She is still nervous. I have a long, winding, narrow, quiet road for her to practice on. She is getting better, and I have to reach over and make corrections less and less. She is finally getting comfortable holding the wheel at "10 and 2", and she is almost used to "hand over hand" to turn the wheel, instead of shuffling her hands. Soon, I will let her try her hand in traffic, but she still panics everytime she sees another car.

She took a driving course back in the Phil's. She was trying to get her learners permit so she can enroll in the AAA drivers education course here locally. I guess we will have to wait for the EAD first then correct ?

The DMV is driving me nuts (pun intended!).

Angela went two weeks ago for the written test, and nobody said anything about the EAD being required.

This morning, she goes for the driving test, and the guy says she can't have her CA DL because her EAD expires before the 60-day time limit they need to process the driver's license.

Now I am wondering how do others deal with car insurance?

Driving is not so much an issue since she has her Brazilian license, but my auto insurance wants her to have a CA driver license within 30 days.

I have been driving around phoenix and nearby town here in AZ.

Can i use the EAD receipt in applying for my driving license. I just applied my AOS (w/ EAD, AP) and hopefully would get my NOA1 by next week. My I-94 is due to expire in March 23, 2009. Plan to get learner's permit first and when i receive my GC, i would do my driving test.

I don't want to loss that freedom of going anywhere i want, anytime i want. :crying:

The EAD will be good for one year. Your California ID Card, or your California Driver's License will expire on the same date. In California, they will send you a renewal notice a couple months ahead of time. Your should have your green card before then. Then you just photocopy both sides, send that to them, and the next will expire when the green card expires. It takes about 2 months for the DMV to process the alien driver's license, or ID card.

In California, they need your EAD first. They have to make copies of that, and then send the application to Sacramento for approval. Takes about two months. Each state is different.
