221g Administrative Processing

I am going through something similar...

... for me noone is telling me anything... ok so here is my case i got married in Jan 2007 and filed for my I 130 in April 2007 ( i should not have waited 3 mo to file but i thought it would be better ) and I filed I 130 spousal visa CR-1

.... ok so finally my petition is approved from USCIS and NVC by May 2008 and they sent over the case to Bombay (wrong consulate) they reschedule our interview at the right consulate, Delhi. My husband went for his interview in July 2008, after the interview they gave him a 221g AP for more proof such as a family tree, addresses and phone numbers of all relatives, guest list, emails, phone records, voters card ok so we sent them everything to the VFS office with his passport. They sent back his passport with no visa. They said its in Administrative Processing....

its been 7+ months and still no word. I went to my Congressmans office and they gave me the same response. I call DOS and they give me the same response "221g administrative processing, etc"

I went to a lawyer and the lawyer said theres nothing he can do for me.... I cant file for the fiance visa because they will reference this case and it will be the same problem....

I have went to India 3 times and Im going this 4th time for 6 months... the first time i went was for 3 months second time was for 5 months and the third time was for a month and now im going to 6 months.

what else should i do ? im soo sad....

Does anyone know what i should do now besides wait?

I just pray to god he will get me through this... Inshallah

SOmetime AP could take up to a yr.

We had everything at the interview but unfortunatly at the interview they dont look at anything.

My advice u can wait . cuz if u apply new visa they will cancel ur CR1 and enyway's u will wait k1 or CR1 u will wait almost 6 or 7 month's till u get approve ... so instead u wait 6 or 7 month's wait k1 approve u can wait ur CR1 and this wont be long ... sometimes they hard at new delhi consulate and they check backgrond now i believe . so wait and u will hear something soon and contact new delhi consulate alot ........... good luck

:) don't worry every case it's different .. sometimes they dont finish a backgond check , so they put case's on AP so u have to be optimistic .. and if u go with ur husband this will be sooo good .... and dont worry u will enter with him to his interview .. and take all proof with u and tell ur husband everything about ur life and ur family so he dont confused infront the consul and will be :D wishing u have the best of luck

First off, K-1 visa is for people who are engaged to be married. You are already married, so it doesn't apply for you, nor can you apply for K-3 because you already have an approved i-130 petition.

I am sorry but all you can do is wait. I am assuming that your husband comes from a Muslim background as you used Inshallah at the end of your question. I don't want to be a bearer of bad news, but a lot of Muslim beneficiaries are put into AP.

As others have stated you can't do anything other than wait, consulates do more of thorough background checks and you will have to wait for their verdict. If your spouse is all clear, there is nothing to worry about, its all the waiting game.

May be you should read through Administrative forum to get more ideas. You can also try MENA forums as a lot of MENA beneficiaries are put through AP.

I hope you get a speedy approval. Keep your faith alive (F)

Have you tried to get information under FOIA act on your case. I am not sure if FOIA will help but you will know what information is in your file. Maybe other VJ members may have more insight into it.

What did you submit with your I-130 & DS230? Is your husband faimily related to your family in any way?

What exactly did they ask your husband? How long was his interview? Did you go with him to the interview? Did you submit marriage photos, marriage invitaiton card, showed them gift/card exchanges, Your e-tickets or your passport arrival stamps.

I am not sure if staying in India for a long time would help or hurt your case because of affidavit of support.

Hi master mind... ok well i submitted emails and photos with my I-130 and DS230. My family is related but very distant.. my cousins married his uncle... we are distantly related. I did not go to the interview with him as I was here. The interview was very short; they only asked one question: How did we meet and my husband said it was arranged by our family.

They gave him a 221g even though he had more things with him at the interview he would not take it. We submitted marriage photos, invitation cards, wedding videos, gifts so many tickets and notarized stamps from my passport. Notarized statement from my mom and his mom on what they think of our marriage, family tree, voters card, list of weddign guests and how they are related to me.

I have never heard of FOIA? Can you please explain to me on what this is?

im leavign to India in 3 weeks so now i won't come back until i am with him. I left my job for him because we started having lil arguments and frustrations b/c of distance.

I will wait to hear ur reply. thanx for responding. :-)

Do a search for FOIA on www.uscis.gov website. Ask your congressman to file it for you. I am not sure if US Embassay have to comply with FOIA act but check with your congress person.
